Notice is hereby given that SEALED PROPOSALS for:
Memorial Park Improvements
H2M Project No.: NYAK2301
will be received by the Board of the Village of Nyack (Owner), at the office of the Village Administrator, 9 N. Broadway, Nyack, NY 10960 until 2:00 p.m., Prevailing Time on Thursday, November 2, 2023, and will be publicly opened and read aloud at 2:00 p.m.
The proposed Memorial Park Improvements, located at 51 Piermont Avenue, Nyack, NY 10960, has been broken into four (4) separate contracts. Bidders may submit multiple proposals as desired; however, if awarded multiple proposals, contracts cannot be combined and must be treated as seperate contracts. The proposed contracts are as follows:
a. Contract A - New ADA Path: The proposed project includes all work associated with the installation of a new accessible walking path and vehicle access.
b. Contract B - Children's Playground Surfacing: The proposed project includes installation of new rubberized playground surfacing, mulching and finishing of areas as specified, and the installation of a new water fountain.
c. Contract C - Great Lawn Restoration: The proposed project includes the rehabilitation and installation of a new grass field, new landscaping plantings, watering, seeding, mulching and establishment of said field area.
d. Contract D - Children's Playground Equipment: The proposed project includes the purchasing and installation of new playground equipment, installation of a new walking path inside the playground area, relocation and corrections to existing playground gates.
Complete sets of Hard Copy Bidding Documents may be obtained from the Office of the Village Administrator, 9 N. Broadway, Nyack, NY 10960 (845-358-0548), or from the Office of the Engineer, H2M architects + engineers, 2 Executive Boulevard, Suite 401, Suffern, NY 10901 (845-357-7238) upon depositing the nonrefundable sum of One Hundred Dollars ($100.00) for each combined set of documents. Checks or money orders shall be made payable to "Village of Nyack". Any bidder requiring documents to be shipped shall make arrangements with the printer and pay for all packaging and shipping costs.

Interested parties are invited to attend a non-mandatory pre-bid conference and site visit, scheduled for 9:00 a.m. on Tuesday, October 17, 2023 at 51 Piermont Avenue, Nyack NY 10960.
Each proposal submitted must be accompanied by a certified check or bid bond, made payable to the Village of Nyack, in an amount not less than five percent (5%) of the total amount of the bid, as a commitment by the bidder that, if its bid is accepted, it will enter into a contract to perform the work and will execute such further security as may be required for the faithful performance of the contract.
The attention of Bidders is called to the fact that this project will be fully or partially funded with Federal Assistance provided to the County of Rockland by the US Department of Treasury under the American Rescue Plan Act (“ARPA Funds”), Section 602(b) and 603(b) of the Social Security Act, Pub. L. No. 117-2 (March 11, 2021) and is subject to certain requirements including 2 CFR Part 200, Uniform Administrative Requirements, Cost Principles and Audit Requirements for Federal Awards. Applicable Federal requirements take precedence over State and local requirements unless State and local requirements are deemed to be more stringent. . All bidders must be registered on SAM.gov and provide proof of registration along with bid documents. Bidders are also required to fill out and sign the Federal Contract Clauses included in these contract documents
The Owner reserves the right to reject any or all bids, waive any informalities and to accept such bid which, in the opinion of the Owner, is in the best interests of the Owner.
