Summary of Specifications:
1. SCOPE: The scope of this bid is to purchase Two (2) HEWLETT PACKARD Servers as specified. Responding firms shall be Hewlett Packard Authorized Distributor/Resellers and include documentation of such with bid response. Equipment shall be NEW UNUSED AND IN ORIGINAL PACKAGING. 2. STANDARDIZATION The County of Rockland has standardized the purchase of Hewlett Packard products (Resolution 426 of 1997). Responses for any other manufacturer shall not be considered and shall be rejected. 3. FUNDING: Funding for this project is by the Federal Transit Administration (FTA). All FTA terms and conditions identified with an "X" in the included FTA clauses shall be met. All required certificates shall be included at time of bid submission or bid SHALL be rejected. 4. DISADVANTAGE BUSINESS ENTERPRISE QUALIFICATIONS The County of Rockland's Department of Public Transportation shall not discriminate on the basis of race, color, national origin, or sex in the award and performance of any FTA-assisted contract or in the administration of its DBE Program or the requirements of 49 CFR Part 26. The recipient shall take all necessary and reasonable steps under 49 CFR Part 26 to ensure nondiscrimination in the award and administration of FTA-assisted contracts. The recipient's DBE Program, as required by 49 CFR Part 26 and as approved by FTA, is incorporated by reference in this agreement. Implementation of this program is a legal obligation and failure to carry out its terms shall be treated as a violation of this agreement. Upon notification to the County of Rockland's Department of Public Transportation of its failure to carry out its approved program, the Department may impose sanctions as provided for under Part 26 and may, in appropriate cases, refer the matter for enforcement under 18 U.S.C. 1001 and/or the Program Fraud Civil Remedies Act of 1986 (31 U.S.C. 3801 et seq.). The contractor or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of FTA-assisted contracts. Failure by the contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy, as the recipient deems appropriate. The County's Department of Public Transportation has set a DBE Participation Goal of 1.8% of the total Contract amount for this contract. While the County of Rockland complies with regulations requiring no quotas or set-asides included in DOT assisted programs, the County of Rockland's Department of Public Transportation strongly encourages DBE participation in all contracts. The County of Rockland's Department of Public Transportation treats bidder/offerors' compliance with good faith effort requirements as a matter of responsiveness and responsibility. The Contractor is required to submit the following information with their bids: 1. The names and addresses of the DBE firms that will participate in the contract; 2. A description of the work each DBE will perform; 3. The Agency that has approved the DBE's Certification. (DBE Certification must be from one of the following four agencies: New York State DOT, MTA, Port Authority of NY & NJ, or The Niagara Frontier Transportation Authority. Copies of Certification must be submitted. 4. The dollar amount of the participation of each DBE firm participation; 5. Written and signed documentation of commitment to use a DBE subcontractor whose participation it submits to meet the DBE requirement; 6. Written and signed confirmation from the DBE that it is participating in the contract as provided in the prime contractor's commitment; and 7. If there is no DBE participation, evidence of good faith efforts. 5. Written confirmation from the DBE that it is participating in the contract as provided in the prime contractor’s commitment; and 6. If the contract goal is not met, evidence of good faith efforts to do so. The County shall make the sole determination as to if good faith efforts have been satisfied. Bidders must present the information required above as a matter of responsiveness (see 49 CFR 26.53(3). The contractor is required to pay its subcontractors performing work related to this contract for satisfactory performance of that work no later than 30 days after the contractor’s receipt of payment for that work from the County. In addition, the contractor may not hold retainage from its subcontractors. The contractor must promptly notify the County, whenever a DBE subcontractor performing work related to this contract is terminated or fails to complete its work, and must make good faith efforts to engage another DBE subcontractor to perform at least the same amount of work. The contractor may not terminate any DBE subcontractor and perform that work through its own forces or those of an affiliate without prior written consent of the County.
