1. GENERAL INFORMATION
The City of Clovis seeks competitive bids to lease approximately 762.25 acres of farmland for a five-year term. The lease will be awarded to the highest responsible bidder.

Lease Term: 5 years (see Appendix A-Farm Lease Agreement)
Use: Agricultural purposes (crop cultivation, pasture, or related husbandry)

City Rights: The City of Clovis reserves the right to terminate the lease at any time if the results or outcome of the lease are unsatisfactory or for any reason determined in the best interest of the City.
2. AWARD AND EVALUATION
● Lease will be awarded to the highest responsive and responsible bidder.
● The City reserves the right to:
○ Reject any or all bids
○ Waive minor irregularities
3. STANDARD LEASE TERMS
3.1 RESPONSIBILITY OF BIDDER
● Bids must include full legal name, address, and authorized signature.
● Bidder assumes responsibility for any cost of bid preparation.
3.2 INDEMNIFICATION
● Lessee shall indemnify and hold the City harmless from all claims, damages, losses, and expenses arising from the use of leased farmland.
3.3 INSURANCE
● Comprehensive general liability: $500,000 per occurrence / $1,000,000 aggregate.
● Worker’s compensation coverage as required by law.
● City of Clovis must be named as additional insured.
3.4 NON-COLLUSION
● Bidder certifies that there has been no collusion or attempt to restrain free competitive bidding.
3.5 DEFAULT
● Failure to comply with lease terms may result in contract termination and liability for damages.
3.6 PROTESTS
● Protests must comply with NMSA 13-1-172 and include a $5,000 protest bond.
3.7 COMPLIANCE
● Lessee must comply with all federal, state, and local laws, including nondiscrimination statutes and safety regulations.
3.8 CAMPAIGN CONTRIBUTION DISCLOSURE
● Required per Chapter 81, Laws of 2006.
3.9 SUSPENSION / DEBARMENT
● Bidder certifies they are not debarred or suspended.

Bids must be submitted in a sealed envelope clearly labeled with:
“ITB 25-1121-04 Lease of City-Owned (Dry) Farmland”
Late, faxed, or emailed bids will not be accepted.
All bids will be publicly opened and read aloud at City Hall immediately following the submission deadline.
Any bid received after the stated time will be returned unopened.
