LEGAL NOTICE Notice is hereby given that sealed bids will be received by the Purchasing Agent, Morris County, New Jersey for the Morris View Nursing Area Renovations, in accordance with the requirements of the plans and specifications. Sealed proposals will be received for a Single Prime Contract for Work of All Trades, with the names of certain Subcontractors to be spelled out on the bid form. The scope of work in this project is to make renovations and alterations to the existing medication prep rooms and nourishment stations. The project work area is defined as Med Prep and Nourishment Rooms adjacent to the Dayrooms located in the South Wing between column lines F/G-8/9, F/G 12/13, and in the North Wing between column lines F/G 35/36 and F/G 39/40. Bids for the above will be received by the Purchasing Agent in the office of the Purchasing Agent, Room 517, Fifth Floor, Administration & Records Building, 10 Court Street, Morristown, New Jersey, at 2:00 p.m. prevailing local time on Thursday, February 28th, 2013 and will be publicly opened and read. The contract shall be awarded to the lowest responsible bidder in accordance with the contract documents. A non-mandatory site inspection and pre-bid conference will be conducted by Morris County on Thursday, February 7th, 2013 only at 2:00 p.m. prevailing time, in the lobby of the Morris View Healthcare Facility, 540 West Hanover Avenue, Morris Plains, New Jersey. Prospective bidders are urged to attend this meeting. Drawings, specifications and other contract documents may be inspected and obtained at the Office of the Morris Purchasing Agent, Room 517, Fifth Floor, Administration & Records Building, Morristown, New Jersey for a non-refundable fee of $50, made payable to “County of Morris”. Bids shall be submitted in duplicate on the forms provided and in the manner designated. Bids must be enclosed in a sealed envelope bearing the name and address of the bidder and the words “Nursing Area Renovations”, addressed to the Purchasing Agent of the County of Morris. Bid proposals shall be delivered to the Purchasing Agent either in person at the hour designated or previous thereto, by delivery or mail, to the Morris County Purchasing Division, Room 517, Fifth Floor, Administration & Records Building, PO Box 900, Morristown, New Jersey 07963-0900. No Bids shall be accepted after the designated time. Morris County will not assume responsibility for bids forwarded by mail or delivery service. The bid must also be accompanied by an Ownership Statement, Statement of Bidder's Responsibility, Non-Collusion Affidavit, a Certificate of Insurance, a Bid Bond and a Certificate from a Surety Company, duly authorized to do business in the State of New Jersey, agreeing to furnish a Performance Bond if the Bidder is successful. Each bidder shall comply with the laws of the United States and the State of New Jersey, including but not limited to the following as the same may be applicable to this contract: (1) The Contract Work Hours and Safety Act, 40 U.S.C.A. Section 327 et. seq., relating to overtime pay and safety. (2) The Copeland "Anti-Kickback" Act, U.S. Laws of June 18, 1934 Chapter 569, 48 U.S. Stat. 979, relating to weekly pay without deductions or rebates except by law. (3) The Davis-Bacon Act, 40 U.S.C.A. 27a et. seq., and N.J.S.A. Title 34:11-56.25 et. seq. as amended, relating to payment of wages not less than those prevailing for similar work in the local area. (4) Use of Domestic Materials on Public Works, N.J.S.A. 52:33-1 e seq. (5) Discrimination in Employment of Public Works Laws, N.J.S.A. 10:2-1 et. seq. (6) Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. (7) New Jersey P.L. 1977, C. 33, requiring corporate and partnership bidders to submit a list of the names and addresses of all stockholders owning 10% or more of their stock or 10% or more of the stock of their corporate stockholders or in the case of a partnership, the names and addresses of those partners owning 10% or greater interest therein. (8) The New Jersey Prevailing Wage Act, Chapter 150, of the Laws of 1963, jointly and severally, with the Wage Determination of the US Secretary of Labor currently in effect. The Act is applicable to all contractors and subcontractors hired by them to work on this project. (9) Public Works Contractor Registration Act (34:11-56.51) Registration required for contractors, subcontractors. No contractor shall bid on any contract for public work as defined in Section 2 of P.L. 1963, c.150 unless the contractor is registered pursuant to this act. No contractor shall list a subcontractor in a bid proposal for the contract unless the subcontractor is registered pursuant to P.L. 199, c.238 at the time the bid is made. No contractor or subcontractor, including a subcontractor not listed in the bid proposal, shall engage in the performance of any public work subject to the contract, unless the contractor or subcontractor is registered pursuant to that act. 34:11-56.55 Submission of all subcontractor registration certificates by contractor. Each contractor shall, after bid is made and prior to the awarding of the contract, submit to the public entity the certificates of registration for all subcontractors listed in the bid proposal. Applications for registration shall not be accepted as a substitute for a certificate of registration for the purposes of this section. (10) Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act, P.L. 1999, c.238 (N.J.S.A. 34:11-56.48), and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). (11) This Proposal is being solicited through a fair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq. The vendor shall maintain all documentation related to products, transactions or services under this contract for a period of five years from the date of final payment. Such records shall be made available to the New Jersey Office of the State Comptroller upon request. The right to reject any or all bids and to waive immaterial formalities is reserved by the Morris County Board of Chosen Freeholders and the Purchasing Agent.
