LEGAL NOTICE Notice is hereby given that sealed bids will be received by the Purchasing Agent, Morris County, New Jersey for the following projects: BID NO. 1 Milling & Resurfacing of Mendham Road – Mendham and Morris Townships beginning 400’ ± west of Yardley Road and running 2.47 miles east thru Indianhead Road. Principal items of work include: 45,950 S.Y. - 2” HMA Milling; 5,775 Tons - Hot Mix Asphalt 9.5 M 64 Surface Course; Various Inlet Repair; Curb Piece Replacement; 24,750 L.F. - 4” Yellow High Performance Inlaid Marking Tape; 19,800 L.F. - 8” White High Performance Inlaid Marking Tape; 1,267 L.F. - Trench Drain & Gutter Swale. Project to be completed by 12/1/10. BID NO. 2 Milling and Resurfacing of Newark Pompton Turnpike – Pequannock Township from Mountain Avenue 0.54 miles south thru Sherman Avenue. Principal items of work include: 12,800 S.Y. - 2” HMA Milling; 1,600 Tons - Hot Mix Asphalt 9.5 M 64 Surface Course; Various Inlet Repair; Curb Piece Replacement; 5,700 L.F. - 4” Yellow High Performance Inlaid Marking Tape. Project to be completed by 12/1/10. BID NO. 3 Milling and Resurfacing of 2010-1 Various Paving Projects (Boonton Avenue) - Kinnelon Borough and Montville Township beginning at Rockaway Valley Road in Montville and running 1.73 miles north into Kinnelon. Principal items of work include: 28,000 S.Y. - 2” HMA Milling; 3,700 Tons - Hot Mix Asphalt 9.5 M 64 Surface Course; Various Inlet Repair; Curb Piece Replacement; Faceplate Installation; 17,740 L.F. - 4” Yellow High Performance Inlaid Marking Tape; 17,720 L.F. - 8” White High Performance Inlaid Marking Tape; 425 S.Y. – Roadway Reconstruction. Project to be completed by 12/1/10. Sealed proposals will be received for a Single Prime Contract for Work of All Trades, with the names of certain Subcontractors to be spelled out on the bid form. Bids for the above will be received by the Purchasing Agent in the Knox Room, Fifth Floor, Room 525, Administration & Records Building, Court Street Morristown, New Jersey, at 2:00 p.m. prevailing local time on Tuesday, October 19th, 2010 and will be publicly opened and read. The contract shall be awarded to the lowest responsible bidder in accordance with the contract documents. Drawings, specifications and other contract documents may be inspected and obtained at the Office of the Morris County Engineer, Room 295, Second Floor, Administration & Records Building, Morristown, New Jersey for a non-refundable fee of $100, made payable to “County of Morris”. Bids shall be submitted in duplicate on the forms provided and in the manner designated. Bids must be enclosed in a sealed envelope bearing the name and address of the bidder and the title of the Bid addressed to the Purchasing Agent of the County of Morris. Bid proposals shall be delivered to the Purchasing Agent either in person at the hour designated or previous thereto, by delivery or mail, to the Morris County Purchasing Division, Room 517, Fifth Floor, Administration & Records Building, PO Box 900, Morristown, New Jersey 07963 0900. No Bids shall be accepted after the designated time. Morris County will not assume responsibility for bids forwarded by mail or delivery service. The bid must also be accompanied by an Ownership Statement, Statement of Bidder's Responsibility, Non Collusion Affidavit, a Certificate of Insurance, a Bid Bond and a Certificate from a Surety Company, duly authorized to do business in the State of New Jersey, agreeing to furnish a Performance Bond if the Bidder is successful. Each bidder shall comply with the laws of the United States and the State of New Jersey, including but not limited to the following as the same may be applicable to this contract: (1) The Contract Work Hours and Safety Act, 40 U.S.C.A. Section 327 et. seq., relating to overtime pay and safety. (2) The Copeland "Anti Kickback" Act, U.S. Laws of June 18, 1934 Chapter 569, 48 U.S. Stat. 979, relating to weekly pay without deductions or rebates except by law. (3) The Davis Bacon Act, 40 U.S.C.A. 27a et. seq., and N.J.S.A. Title 34:11 56.25 et. seq. as amended, relating to payment of wages not less than those prevailing for similar work in the local area. (4) Use of Domestic Materials on Public Works, N.J.S.A. 52:33 1 e seq. (5) Discrimination in Employment of Public Works Laws, N.J.S.A. 10:2 1 et. seq. (6) Affirmative Action Against Discrimination in Employment Laws, N.J. P.L. 1975, C. 127. N.J.A.C. 17:27. (7) New Jersey P.L. 1977, C. 33, requiring corporate and partnership bidders to submit a list of the names and addresses of all stockholders owning 10% or more of their stock or 10% or more of the stock of their corporate stockholders or in the case of a partnership, the names and addresses of those partners owning 10% or greater interest therein. (8) The New Jersey Prevailing Wage Act, Chapter 150, of the Laws of 1963, jointly and severally, with the Wage Determination of the US Secretary of Labor currently in effect. The Act is applicable to all contractors and subcontractors hired by them to work on this project. (9) Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act, P.L. 1999, c.238 (N.J.S.A. 34:11-56.48), and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). Pursuant to P.L. 2004, c.57 (N.J.S.A. 52:34-44), all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. Bidders and their subcontractors must submit proof that at the time of the bid opening they are registered with the New Jersey Department of the Treasury, Division of Revenue, by submitting a copy of their Business Registration Certificate prior to contract award. (10) This Proposal is being solicited through a fair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq. The right to reject any or all bids and to waive immaterial formalities is reserved by the Morris County Board of Chosen Freeholders and the Purchasing Agent.
