Request for Proposals for Buffalo Run Golf Course Equipment Wash Bay Improvements

Date: March 8, 2018

  1. REQUEST FOR PROPOSALS
The City of Commerce City (“City”) seeks proposals for the provision of removal and replacement of concrete wash bay pads, repair of underground drain components as needed, backfill and compaction of sub base soil and re-pour new concrete pads services (“Services”), on a non-exclusive basis, as set forth in this Request for Proposals (“RFP”).
The anticipated start date is 4/16/2018. The term for this project is for 30-day period, and is not subject to renew.
A recommended site visit will be held March 14, 2018 at 10:00 AM at the Buffalo Run Golf Course Maintenance Facility 15800 E. 112th Ave. Commerce City CO 80022.
Questions regarding RFP requirements must be received by Kirk Reiber, Golf Course Maintenance Superintendent in writing at kreiber@c3gov.com by 3:00 PM MT on Friday, March 16, 2018.  Oral and late questions will not receive responses.
Proposals containing the information required by this RFP, in the format described below, must be received no later than 4:00 p.m. (MT) on Friday, March 23, 2018.  Proposals shall be submitted in a sealed envelope and plainly marked “Proposal for Buffalo Run Golf Course Maintenance Equipment Wash Bay Improvements” on the outside of the sealed envelope. Proposals must be submitted to:

It is the sole responsibility of each Respondent to ensure its Proposal is received by the City by the date and time stated in this RFP.  Late Proposals will not be accepted.
  1. SCOPE OF SERVICES
The contractor shall perform all Services described in this section and all obligations set forth in the attached Agreement for Services.
The contractor will: See Exhibit A and  Exhibit B, Scope of Work and Drawings.
 
  1. PROPOSAL REQUIREMENTS
Interested Respondents shall submit Proposals including the following information in the order listed below to facilitate fair and equal evaluation of Proposals.
  1. PROPOSAL LETTER.  Identify the Respondent and articulate why the Respondent is qualified to provide the Services (including the proposed method, qualifications, and two client references).  Include the name, address, email address and phone number of the person who will serve as the Respondent’s principle contact with City staff.
  2. EXCLUSIONS.  The Respondent must include any proposed exclusions to the Services or draft contract.
  3. BID FORM. The Respondent will complete the attached Bid Form. Prices must include all items of work to be done and materials to be furnished to fully complete the work (including without limitation the cost of appurtenant items of work, labor, materials, fees, bond costs, supplies, utilities, royalties, tools, forms and equipment, and all other costs (including without limitation sales and use tax, insurance, licenses, permits, profit, and other overhead) not listed separately or not specified but necessary to complete the work.
  4. ADDITIONAL INFORMATION.  The Respondent may list any additional information or data not requested as part of this RFP that Respondent believes should be considered in the evaluation of the Proposal provided the entire Proposal is no more than the identified page limit.
  1. SELECTION
The City will use a qualitative-based selection process using the following criteria:
  • Respondent qualifications
  • Past experience, representative work, and references
  • Proposed method and approach to fulfill the City’s needs
  • Price
Interviews may be requested once Proposals have been reviewed. The City may contact references provided with the Proposal.  The City reserves the right to request clarification or additional information from Respondents and to consider independently obtained information.
The City will select the Respondent determined to be the best value by the City in its sole discretion.  In addition to the criteria stated above, the City’s determination may consider, without limitation, the Bidder’s financial resources, ability to comply with all legal and regulatory requirements, ability to perform the Work and complete the Project on time, history of performance, reputation, ability to obtain necessary equipment, data, and facilities, and any other factor deemed important by the City, including location within the City.  
The City reserves the right to negotiate further with the selected Respondent. Selection of any Contractor and execution of a contract is dependent on approval in accordance with applicable City laws and policies and the City’s receipt of any required Certificates of Insurance and applicable endorsements. The City’s decision is final and without recourse to any Respondent. 
  1. MISCELLANEOUS
  1. NO COMMITMENT BY THE CITY.  This RFP does not commit the City to award any contract, to pay any costs associated with this RFP, including the preparation or submission of a proposal, interviews, supplemental proposals or the negotiation of a contract, or to procure or contract for any services. The decisions of the selection committee and the City with respect to this RFP are final and without recourse to any respondent.  In acceptance of Proposals, the City reserves the right to negotiate further with one or more respondents in the best interest of the City.  
  2. CHANGES TO RFP.  Revisions to this RFP will be made through addenda published and made available to all Respondents on the City’s website and on the Rocky Mountain E-Purchasing System (RMEPS). Any other communication, spoken and written, formal and informal, received by any representative of any respondent from sources other than official addendum shall not be effective to vary any term of the RFP.
  3. NO COLLUSION.  No officer or employee of the City, and no other public official or employee, who may exercise any function or responsibilities in the review or approval of this undertaking shall have any personal or financial interest, direct or indirect, in any contract or negotiation process thereof.  This “no collusion” requirement shall be part of any City contract for the Services.
  4. RESERVATION OF RIGHTS.  The City reserves the right to reject any or all Proposals, in its sole discretion.  The City reserves the right to modify this RFP or the selection process, to cancel this RFP, and to waive any informalities or irregularities in any Proposal or in the selection process, without liability, at any time. 
  5. REQUIRED DOCUMENTS.  The selection of any respondent, and the award of any contract, is dependent on the completion of the Professional Services Agreement and the receipt of the required Certificate of Insurance and applicable endorsements.
  6. PROPERTY OF CITY. All Proposals shall become the property of the City, will not be returned, and will become a public record. 
  7. CONDUCT.  Respondents are cautioned not to undertake any activities or actions to promote or advertise their submittals, other than discussions with City staff as described in this RFP.  After the release of this RFP, respondents are not permitted to make any direct or indirect contact with members the City Council, City staff, or media on the subject of this RFP, except in the course of City-sponsored presentations.  Violation of these rules is grounds for disqualification of the respondent.
  8. CONTRACT TERMS. By submitting a proposal, each respondent confirms that it has reviewed and accepts the terms and conditions of Attachment A subject to explicit proposed revisions identified in the Respondent’s proposal. No proposed changes shall be deemed accepted by the City unless explicitly incorporated into the executed contract.
  9. DEBARMENT. A respondent may be disqualified, and must disclose to the City, if the respondent or any of its principals are debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in any contract by any Federal department or agency.
  10. CONFIDENTIALITY. Respondents may request parts of their Proposals to remain confidential by indicating such in the Proposals and on the appropriate proprietary or financial pages. The City will take reasonable steps to keep confidential only documents actually protected from disclosure under the Colorado Open Records Act (the “Act”), including notifying the Respondent of a request and allowing the Respondent to take steps to prevent disclosure. An entire Proposal shall not be marked or identified as confidential.  By submitting a Proposal, each Respondent agrees to hold the City harmless from any claims arising from the release of proprietary information not clearly designated as such by the Respondent or where the City has notified the Bidder of a request and from any claims arising from the release of documents not protected from disclosure under the Act.
