NOTICE INVITING BIDS
1. NOTICE. The City of Santa Clara, California, a chartered California municipal corporation, (“City”) hereby gives notice that it will accept bids for construction of the following public work:
2025 ANNUAL STREET PAVEMENT MAINTENANCE AND REHABILITATION PROJECT

2. BID SUBMISSION. City will receive sealed Bids electronically over the internet via BidNet Direct, until 3:00 p.m., as determined by BidNet Direct’s time keeping system and the City Clerk, on April 10, 2025. Bids will be opened shortly thereafter on that same day. The opening will be in accordance with procedures set forth in Document 00250, Bid Contents, Evaluation, Selection, and Award.

4. STATEMENT OF QUALIFICATIONS. Each Bidder shall be required to submit a Statement of Qualifications in accordance with Document 00200, Instructions to Bidders, and Document 00450, Statement of Qualifications for Construction Work.
5. DESCRIPTION OF WORK. The Work shall consist of pavement maintenance and rehabilitation at various streets citywide as shown on the Plans. The work is comprised of the following features: slurry seal, repair of failed pavement (deep-lift), cold milling of existing pavement, hot mix asphalt and rubberized hot mix asphalt pavement resurfacing, replacement of traffic signal loop detectors, adjusting of valve boxes, manholes, and surface utility features, adjusting and replacing street survey monuments, replacement and installation of accessible concrete curb ramps, and traffic markers, striping and pavement markings. The work also includes mobilization/demobilization, traffic control, permitting and agency coordination, and other incidentals necessary for complete and usable street facilities.
6. CONTRACT TIME. The Work shall reach Substantial Completion within One Hundred (100) Working Days from the date when the Contract Time commences to run. The Work shall reach Final Completion within One Hundred Ten (110) Working Days from the date when the Contract Time commences to run. See Document 00050, References and Definitions, for definitions of Substantial Completion and Final Completion.
For the purposes of these provisions, the Award of Contract by the City Council is anticipated to be during May 2025 and Notice to Proceed and first day of work is anticipated to be by July 2025. The preceding dates are provided for Bidders’ reference only with regards to estimating the first day of work, but are non-binding and are subject to change.
7. REQUIRED CONTRACTOR’S LICENSE(S). A California “A” contractor’s license is required to bid this contract. Joint ventures must secure a joint venture license prior to award of this Contract.
8. REQUIRED CONTRACTOR AND SUBCONTRACTOR’S REGISTRATION. The Bidder and subcontractor(s) must be registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposed only under Labor Code section 1771.1(a)]. The Bidder or subcontractor(s) may not be awarded the Contract unless registered as noted above.
9. PREVAILING WAGE LAWS. The successful Bidder must comply with all prevailing wage laws applicable to the Project, and related requirements contained in the Contract Documents. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.
Each Contractor and every lower-tier Subcontractor will be required to submit certified payrolls and labor compliance documentations electronically via the software LCPtracker. Contractor shall cause all subcontracts to include the provision that all Subcontractors submit certified payrolls and labor compliance documentation electronically via LCPtracker. Electronic submission will be a web-based system, accessed on the World Wide Web by a web browser. Each Contractor user will be given a Log-On identification and password to access the City’s reporting system. Access will be coordinated by a City representative.
10. INSTRUCTIONS. Bidders shall refer to Document 00200, Instructions to Bidders, for required documents and items to be submitted electronically over the internet, followed by hard-copy submittal in sealed envelopes to the City Clerk’s office, and applicable times for submission.
11. SUBSTITUTIONS OF SECURITIES. City will permit the successful Bidder to substitute securities for retention monies withheld to ensure performance of Contract, as set forth in Document 00680, Escrow Agreement for Security Deposits in Lieu of Retention, in accordance with California Public Contract Code, Section 22300. By this reference, Document 00680, Escrow Agreement for Security Deposits in Lieu of Retention, is incorporated in full in this Document 00100, Notice Inviting Bids.
12. PRE-BID CONFERENCE AND SITE VISIT. City will not conduct a Pre-Bid Conference and Site Visit. Bidders are encouraged to visit the site(s).

14. PROCUREMENT OF BIDDING DOCUMENTS. The Bidding Documents will be issued electronically through BidNet Direct, an online bid solicitation website. Bidders may access the City’s projects advertised for Bid on BidNet Direct by following the link on City’s website at https://www.santaclaraca.gov/our-city/departments-a-f/finance/purchasing/bid-opportunities. All documents and information related to this Bid will be issued through the BidNet Direct website, including, Bidding Documents, Addenda, and Questions and Answers. The Bidder is responsible for printing of any documents issued through BidNet Direct at their own cost. When a Bidder registers through the BidNet Direct website and downloads all Bid Documents they become a planholder and BidNet Direct will send notifications when information related to the Bid changes, including issuance of Addenda and Questions and Answers. Bidders may register through the BidNet Direct website and view the Bid free of charge. Bidders are responsible for checking BidNet Direct to make sure they have the most current information about this Bid. In the event a bidder obtains information about this Bid through any means other than BidNet Direct, City will not be responsible for the completeness, accuracy or timeliness of the final bid.
Upon request by the successful bidder, the successful bidder will be provided with up to five (5) complete sets of Plans and Specifications, for construction use, after the award of Contract. The successful bidder will be responsible for all costs for additional sets for its firm and its subcontractors, beyond those provided by the City.
15. BID PREPARATION COST. Bidders are solely responsible for the cost of preparing their Bids.
16. RESERVATION OF RIGHTS. City specifically reserves the right, in its sole discretion, to reject any or all Bids, or re-bid, or to waive inconsequential deviations from Bid requirements not involving time, price, or quality of the Work.
