Specifications include, but are not limited to: The work under this contract is controlling Japanese knotweed (Polygonum cuspidatum) at sixteen (16) sites around the City of Madison, as shown on Attachments D and E. The Contractor shall control the Japanese knotweed infestations with two (2) treatments per growing season. If previously untreated or new Japanese knotweed plants are found growing on a site during the course of the contracted work, treatments will begin again as soon as possible after plants are discovered—if found prior to July 31, sites will undergo both cutting and herbicide treatment. If found between July 31 and October 31, plants will undergo one herbicide treatment. Herbicides used shall be Journey (imazapic + glyphosate) or Polaris AC (imazapyr). Herbicide substitution requests must be approved by the Project Manager. Herbicides shall be applied according to label instructions. The Contractor is responsible for acquiring and maintaining all certifications related to pesticide applications. If necessary, the Contractor is responsible for acquiring and maintaining all WI Department of Natural Resources (DNR) permits related to the use of pesticides on aquatic sites and for sharing copies of these permits with the Project Manager. The Contractor is responsible for following all posting and other pesticide application policies as laid out in the City’s Pesticide Use Policy, Attachment B. The Contractor is responsible for maintaining all pesticide use records using the pesticide application record form in Attachment C. Sites included in this contract are listed and mapped in Attachments D and E. All sites were treated in 2019. Sites in Attachment D are part of a DNR Aquatic Invasive Species (AIS) grant. The Contractor shall itemize and invoice City Engineering separately for AIS grant sites listed in Attachment D. Sites in Attachment E are all along the Southwest Commuter Bike Path on Madison’s west side and are not part of the AIS grant. The Contractor shall itemize and invoice City Engineering separately for non-AIS grant sites listed in Attachment E. As indicated in Attachments D and E, some sites are on private property or railroad property. The Project Manager shall supply a signed Right-of-Entry form from property owners to the Contractor before treatment may begin. The Contractor shall not pursue Japanese knotweed control on any private property without posession of a signed Right-of-Entry form. The Contractor or any crew members performing control work on private property must keep a copy of the signed Right-of-Entry from with them at all times while on site. Under MGO 23.29 Noxious Weed Ordinance, the railroad, having failed to comply with notices sent in 2019 and 2020 has ceded authority to the City to pursue noxious weed control on railroad land and as such the Contractor may pursue work on railroad property without a Right-of-Entry form.
