Specifications include, but are not limited to: Hearings: The Contractor shall provide all labor, supervision, equipment, tools, materials, and incidentals necessary to provide the contracted services. An electronic transcript must be provided in every instance where a transcript is requested. Paper originals are required only when indicated. A. Informal Fact-Finding Conferences and Formal Hearings: Regulatory cases, including typing testimonies of parties, witnesses, etc. The Contractor must ensure that all exhibits are properly labeled in the transcripts. No paper originals are required unless requested by Virginia ABC. B. Court Hearings: Regulatory cases, including typing testimonies of parties, witnesses, etc. A transcript and a paper original must be provided to the designated representative of the Office of the Attorney General with an electronic version being provided to Virginia ABC. C. Public Hearings: Hearings, including typing testimony of the general public and representatives of Virginia ABC. No paper originals are required unless requested by Virginia ABC. Transcripts: A. Transcripts, if requested, must be submitted in a format compatible with Virginia ABC software and be in a searchable PDF format with signatures. Digital protection of the file must allow Virginia ABC to bookmark, copy, and print pages as required. B. Virginia ABC reserves the right to make as many copies of the original as necessary for internal purposes at no additional cost. The Contractor understands that Virginia ABC will comply with the Freedom of Information Act (FOIA, §2.2-3700 et. seq. of the Code of Virginia) and may copy and distribute transcripts to comply with FOIA at no additional cost. C. If a member of the public requests a copy of the transcript other than covered by FOIA, the Contractor may agree to a rate directly with the requestor as long as such request is outside the terms of this contract. D. The Contractor will copy the appropriate staff members on the email when sending transcripts to Virginia ABC. E. Transcripts must be delivered to Virginia ABC within 10 calendar days after the proceeding, unless otherwise requested. If the 10th calendar day falls on an internal departmental deadline, Virginia ABC reserves the right to request advance delivery of transcripts impacted by this deadline. F. If paper transcripts are requested, they shall be submitted absent of any cover or binder. Pages are to be bound in the upper left hand corner by staple or binder clip. G. Transcripts must be submitted no later than 4:00 PM (EST) on the due date. H. Transcripts received after the due date will be subject to a 10% penalty. The penalty shall increase by 2% for each day the transcript(s) is/are late. This late fee shall not exceed 25% of the total cost of the transcript(s). I. The Contractor must inform Virginia ABC in writing in advance and no later than two (2) days prior to the due date in the event transcripts will be delivered after the due date. The Contractor must provide Virginia ABC with the date of hearing, due date, and anticipated delivery date. With prior Virginia ABC approval, the penalty for late delivery may be waived. J. Transcripts containing substantive errors are subject to a 10% penalty. Corrected transcripts received within the due date will not be subject to an additional late penalty. Corrected transcripts received after the due date shall be subject to a 2% penalty for each day past the due date, not to exceed 25% of the total cost of the transcript(s). K. Transcripts delivered past deadlines without prior Virginia ABC authorization, up to 10 missed deadlines per year and/or repeated incidences of documents containing substantive errors up to 10 per year, may result in termination of the contract. Expedited Transcripts: A. In all cases, Virginia ABC will endeavor to provide advance notification to the Contractor of the need for expedited transcripts. If however, Virginia ABC is unable to provide advance notification, Virginia ABC staff and Contractor must agree on a delivery date. Such discussion of delivery date must take place without parties and/or participants to the proceeding present. B. Expedited transcripts received late will be paid at the next lowest delivery rate (e.g. transcripts ordered at the 5-day rate delivered on the 6th day will be paid at the 7-day rate). C. Virginia ABC and Contractor shall only request delivery and payment of expedited transcripts in accordance with the terms of the contract.
