Specifications include, but are not limited to: The University is seeking a Contractor to provide the following services, but not limited to: • Title IX Decision Maker • Title IX, Title VI and Title VII Investigator • Advisor Services • Appeal Officer Title IX Decision Maker presides over Title IX hearings and provides a written determination of responsibility. 1. Follow procedures outlined in the CNU’s Title IX policy 2. Respectfully, efficiently, and effectively overseeing and controlling a hearing; Overseeing relevant crossexamination; Controlling the hearing, particularly in the presence of experienced counsel on one side and potentially no legal representation on the other; 3. Ruling on the admissibility of evidence; 4. Understanding the meaning of relevance; 5. Making and effectively communicating determinations of responsibility with sound reasoning; 6. Applying the presumption of innocence; 7. Drafting a written determination of responsibility using the “preponderance of the evidence” standard of proof as well as including other information in the written determination as required by federal law and/or University policy. Title IX, Title VI and Title VII Investigator conducts an independent, internal investigation and produce an investigative report in a timely manner. 1. Conduct individual interviews in person or via electronic platform (zoom, etc.). Interviews may be conducted over the phone if requested by the party/witness or determined necessary. 2. Produce draft investigation report in accordance with CNU policies and federal regulations. Advisor (Services) provides advisory support on behalf of either the complainant or the respondent. 1. Provides advisory support in reviewing and responding to the draft investigation report, the final investigation report, and the appeal process. 2. Provides pre-hearing consultation. 3. Conducts cross-examination on behalf of either the Complainant or the Respondent; advisors must be available to attend the hearing. Appeals Officer reviews appeal(s) submitted by either/both parties involved in the case. 1. Reviews appeals in timely manner in accordance with CNU policy and federal regulations. 2. Produces final appeal letter to either/both parties.
