a) Legal advisor to the CRHA Board of Commissioners. Board meetings are held, usually on a monthly basis on the last Wednesday of the month at 5:00 p.m. From time to time, a special meeting of the Board may be called to address particular urgent matters that may not wait for the next regularly scheduled meeting. Duties in this capacity include: 1. Review Board meeting agendas to ensure compliance with applicable state and local laws. 2. Attend Regular and Special Board Meetings and be prepared to advise the Board regarding: a. Relevant regulatory requirements that govern federally subsidized housing programs. b. Relevant contractual or inter-local agreement obligations that either are or may become binding upon the CRHA. c. The legal impact and/or consequence of administrative policy decisions. d. CRHA policies and procedures. e. CRHA by-laws. f. Relevant Code of Federal Regulations (CFR), Virginia Revised Statutes and Municipal codes. g. Responding to inquiries by Commissioners and the Public. b) Legal advisor to the Executive Director and/or his/her designee. Duties herein include a wide variety of services encompassing the Authority’s routine business operations and any other issues that may arise during the course of operations. Work typically involves: 1. Real property acquisition, disposition and loans including; a. Title Examination, Preliminary Opinion and Certificate of Title. b. Preparation of Deed or Deed of Trust and Note. c. Settlement, including execution of instruments, disbursement of funds and recordation of instruments. d. Preparation of Contracts of Sale and Deeds of Conveyance e. Closings (estimate 10 to 15 per year). 2. Human Resources function, including: Equal Employment Opportunity Commission (EEOC) and other related matters. Personnel policies and procedures - creation, implementation and interpretation of new and old. Employment discrimination claims. Disciplinary procedures and actions. Hiring, firing and reclassification matters. Worker’s compensation claims. OSHA matters. Section 504 compliance issues. Federal, State, and Local regulations regarding employment. Collective bargaining. Generally, human resources related issues amount to review of one or two documents in a year’s time and three or four phone calls or email inquiries per year. The possibility of a protest or claim always is present but in the last three years, there have been no actions. 3. Operations, including: Fair Housing claims involving violations of the Fair Housing Act, ADA violation claims, claims regarding violation of Section 504 of the Rehabilitation Act any hearings regarding Fair Housing issues. Public Housing Program. Section 8 Voucher Program. Landlord/tenant issues, including evictions, possession, lease preparation and interpretation, premise liability issues, Unlawful Detainers for nonpayment of rent or lease violations (actions for Affordable Housing and Managed Properties sent on the 12th of each month and Public Housing properties sent on the 20th of each month) writs of possession (required within 24 hours of the Landlord being granted possession of the unit) Judgments for nonpayment of debt (warrant and debt on former tenants). Condemnation of Property. Grants. Bond Issuance.
