Provide a large-scale water slide over specified City streets. The slide shall be a minimum of 800 feet in length. Offeror shall submit all necessary paperwork to Risk Management and the City of Hampton as required by this Agreement. Security engaged for this purpose must obey all local, state, and federal rules, regulations, and laws. 1. Length of Program: The one-day event shall be at least 6 hours in length. 2. Program Criteria: A representative of the City of Hampton shall conduct inspections at least one (1) hour prior to the slide being operational. Times of slide operation shall be determined after selection of Offeror. Arrangements shall be made for access to the slide site a minimum of twelve (12) hours prior to the event. Offeror shall provide all necessary safety equipment and all necessary tools and materials. In addition, the City shall close down the designated area for the event to include setup and break down. There is no estimated value of additional offerings at future events as services shall be requested on an as-needed basis. Each project shall have its own work order and scope of work. The awarded Offeror(s) shall prepare a quote for providing the required services. Any questions pertaining to any work order and/or fees shall be conducted through Parks, Recreation and Leisure Services or other City departments. Each work order shall be performed for a "not to exceed" cost and a purchase order will be issued by the City, calculated according to the price rates per the Offeror’s contract, with discounts taken as agreed by both parties. A written notice to proceed shall be issued for each project. 3. Inclement Weather: In the event the City, in its sole discretion, postpones the program due to inclement weather, the City reserves the right to reschedule or to completely cancel the program. If rescheduled, the City and Offeror shall determine a mutually agreeable reschedule date; and Offeror shall apply any payment received toward the completion of services for the reschedule date. Offeror shall include in its bid response the amount the Offeror may charge if the program is completely cancelled due to inclement weather or other force majeure event. 4. Condition of Site: The Offeror shall be responsible for removing all materials, debris, packing materials, etc. upon completion of event. The City of Hampton shall be responsible for picking up small debris. Removal of all materials shall be completed during the breakdown timeframe. 5. Storage: The Offeror shall assume all responsibility and liability in connection with the storage of equipment, tools and needed materials. 6. Permits and Licensing: The Offeror shall obtain all required permits and licenses from the City of Hampton and Commonwealth of Virginia necessary to conduct business as stated. Offeror shall be responsible for any associated fees. 7. Crowd Control: The Offeror shall be responsible for operation and safety measures as it pertains to the waterslide. The City shall provide crowd control and site security throughout the event area as deemed necessary. 8. Contractor Responsibility: The Offeror is the Prime Contractor for purposes of this contract and shall be responsible for completely supervising and directing the setup, operation and breakdown. Subcontractors who perform work under this contract shall be responsible to the Prime Contractor. The Prime Contractor agrees that it is as fully responsible for the acts and omissions of its subcontractors and of persons employed by them as it is for the acts and omissions of its own employees. 9. Taxes: The Offeror shall pay all sales, consumer, use and other similar taxes required by the laws of the localities where activation takes place.
