• VTrans shall have the right to inspect all equipment rented under this agreement and has the right to reject any equipment which VTrans deems to be unsuitable for maintenance activities. • Contractor warrants that all operators have the required licenses, permits and certifications for the operation of VTrans and the Contractors equipment. • Contractor shall not be allowed to assign or subcontract any portion of this contract, without the written permission of VTrans. • VTrans District General Manager and/or the Transportation Area Maintenance Supervisor (TAMS) will coordinate scheduling and supplemental maintenance needs on a weekly basis with the Contractor. • Contractor shall take care not to damage State property and assets including but not limited to State buildings, property of any kind, roadway infrastructure including guardrails, curbs, and drainage structures as well as the traveling public. Contractor will make repairs to material damaged during performance of maintenance activities. Determination of the need for an extent of repair is the sole discretion of the VTrans District Transportation Administrator within the applicable region. • VTrans will strive to accommodate work location requests from Contractors. If VTrans equipment and staffing requirements have been met at the requested location, VTrans will attempt to offer an alternate work location where equipment and/or staffing is needed.
