Specifications include, but are not limited to: E.1 Vendor shall make four (4) attempts to hand-deliver the legal documents to the subject identified by TWC with one or more attempts being made during the evening hours and, if necessary, on the weekend. If service cannot be accomplished at the addresses provided by TWC, vendor must provide TWC, written notification of all service attempts within twenty-four (24) hours after the last attempt. The notification must include the time, date, location and findings of each service attempt. Upon receipt of this written notification, TWC shall be allowed forty-five (45) calendar days in which to provide vendor with a valid address. During this forty-five (45)-day period the vendor shall also attempt to locate a valid address. If vendor or TWC locates a new address in the same county during this forty-five (45)-day period, service at the new address shall be attempted without any additional charges to TWC. If vendor locates a new address in a different county during this forty-five (45)-day period, vendor shall obtain approval from TWC to attempt service at the new address. Vendor may charge an additional service fee, except as provided in Section E.2. If the new service address requires service by certified mail restricted delivery, no additional service fee shall be charged. If service cannot be accomplished at the new addresses or if TWC fails to provide vendor with a new address within the forty-five (45)-day period, vendor shall return to TWC the original service document with a notarized affidavit as provided in Section E.5. E.2 TWC may specifically request that service be attempted by certified mail restricted delivery. When all attempts to serve a document are made by certified mail restricted delivery, vendor shall not charge TWC an additional fee when different counties are involved. When service by certified mail restricted delivery is accomplished the United States Postal Service (USPS) Form 3811 "Return Receipt" must be signed by the subject designated for service. Vendor shall return to TWC the "Return Receipt" with the service document and notarized affidavit of the serving agent. Vendor shall be responsible for resolving discrepancies with certified mail service with the USPS (Example: "wrong person signed for mail" when restricted delivery was designated.)
