Specifications include, but are not limited to: Phase I – Quantitative Data Collection and Analysis Establish the legal basis for conducting an updated Minority and Woman-owned Disparity Study, to include the current constitutional standards and case law on race-conscious government efforts in public contracting; Determine SAWS’ appropriate geographic market area; Determine SAWS’ product markets by NAICS code or by major procurement categories (Heavy Civil Construction, Engineering Design, Other Professional services, and Procurement (general services and commodities) that are most indicative of work performed on SAWS contracts; Determine SAWS’ utilization of M/WBEs, classified by industry, race/ethnicity, and gender in the agency’s geographic and product markets; Determine the availability of M/WBEs (classified by industry, race/ethnicity, and gender) in SAWS’ geographic and product markets; and Provide statistically significant evidence of disparities, if they exist, between SAWS’ utilization of M/WBEs and the availability of such firms in SAWS’ geographic and product markets; Phase II – Qualitative Data Collection and Analysis Collect and analyze anecdotal/qualitative evidence on the experience of businesses in SAWS’ markets; Phase III – Private Sector Analysis Determine whether and to what extent discrimination and/or disparity exists in the private sector. This determination will require an analysis of M/WBEs’ private sector success relative to nonM/WBEs’ private sector success
