Specifications include, but are not limited to: 5.2.1 The Medical Service Provider shall collect the breath and urine specimens on site. For example, the Office of Transportation, Food Service, Maintenance or any other location designated by the District. This shall include using an Evidential Breath Testing Device (EBT) and include immunoassays for the designated drugs (or classes of designated drugs) and include cut-off levels to determine whether the specimen is negative. 5.2.2 The Medical Review Officer (MRO) shall evaluate the employees whose test results are positive to determine what assistance, if any, the employee needs in resolving problems associated with alcohol misuse and prohibited substance use as required in 49 CFR 382.605. 5.2.3 Negative drug screen results will be reported to the designated CCISD representative within 24 hours of receipt by the laboratory Positive results shall be reported verbally along with written notification within three (3) working days of the completion of the medical review, Section 382.407. The Medical Service Provider will generate and retain original records of alcohol and control substance results for the District for one calendar year as required in 49 CFR Subpart D 382.409. Copies of the test results will be provided to the District at no additional costs. 5.2.4 The District through the MSP will provide the blind performance samples to fulfill the requirement of 49 CFR Part 40 section 40.31. Should the laboratory report any blind blank specimen as a confirmed positive or fail to detect and correctly identify any drug or controlled substance which was intentionally added to a blind sample, the Medical Service Provider will notify the testing laboratory and the District within 72 hours. 5.2.5 The random selection testing process will be provided via a computer program that meets all Federal requirements 49 CFR Section 382.305(f), for randomly selecting employees for alcohol and/or controlled substance testing. All employees may be subject to unannounced testing throughout the year in an objective random selection process. The District will provide the eligible employees' social security number, which will remain in the selection pool throughout the process. In addition, the list of eligible employees will be regularly monitored for additions and deletions. 5.2.6 Supervisors designated to determine whether reasonable suspicion exists to require a driver to undergo testing shall receive at least (60) minutes of training on alcohol misuse and an additional (60) minutes of training on controlled substance use. The training shall be provided by the MSP and shall cover the physical, behavioral, speech, and performance indicators of probable alcohol misuse and use of controlled substance, 49 CFR 382.307; 382.603. 5.2.7 All MSP's shall submit with their proposal the following documents: protocol for specimen collection per 49 CFR Part 40 Subpart B 40.23, 40.25 and Subpart C 40.63 and 40.65. In addition the medical Service Provider shall submit the name of the lab certified through Substance Abuse and Mental Health Services Administration, analytical methodologies, Medical Review Officer Certification and Substance Abuse Professional with knowledge of and clinical experience in the diagnosis and treatment of alcohol and controlled substance related disorders, VITAE, educational training components, and Certificate of Insurance.
