1.0 The contractor shall guarantee to perform all work in a manner satisfactory to and acceptable by Montgomery County. 2.0 The contractor shall provide all necessary labor, equipment, and materials for performing defined services. 3.0 The contractor shall supply all containers for commercial use at the listed locations provided. 4.0 The contractor shall agree to pick-up all types of solid waste refuse from said containers/ dumpsters consistent with all rules regulations, etc., promulgated by Department of State health Services (DSHS) and/or Texas Commission on Environmental Quality (TCEQ). 5.0 The contractor shall agree to maximize sanitary conditions. The containers/dumpsters must be deodorized and disinfected as needed and/or on a per call basis, on site or by actual replacement, at no additional charge to Montgomery County. 6.0 The contractor shall keep all refuse containers/dumpsters in safe working condition, and shall assist Montgomery County in its effort to minimize visual obtrusiveness. 7.0 The contractor shall be responsible for all permits, fees, and expenses related to the disposal of trash in a manner consistent with all applicable rules, regulations, etc., promulgated by the (DSHS) and/or (TCEQ). 8.0 The contractor must submit the number of the (TCEQ) permit for each solid waste processing facility and solid waste disposal area operated by the contractor which will be used for the purpose of processing or disposing of the solid waste collection from the Montgomery County buildings and facilities. 9.0 If the contractor plans to use a solid waste processing facility or disposal area operated by any person other than the contractor, the contractor must submit the name and address of the operator, and the name, address and permit number issued by the (TCEQ) of all such facilities and areas. 10.0 If Montgomery County discovers the contractor is disposing of collected waste in an area that is not a permitted disposal site, Montgomery County reserves the right to cancel this contract immediately for cause and pursue legal action if necessary
