The bidder, having thoroughly examined the contract documents, including all issued addendums, plans, specifications, the site of the project and understanding the amount of work to be done and the prevailing conditions, hereby proposes to do all the work, furnish all labor, equipment, and material, except as specified to be furnished by the City, which is necessary to fully complete all of the work as provided in the plans and contract documents and subject to the inspection and approval of the City of Rowlett, Texas, and binds himself upon acceptance and award of this bid to execute a contract and furnish all required insurance, sureties and bonds, as may be required by the contract documents for the performing and completing of said work. Contractor proposes to do the work within the time stated at the bid prices submitted and agrees to abide by the terms and statutory requirements governing the solicitation process.
All addenda shall be issued in written form by the Purchasing Office. The City is not bound by any oral representations, clarifications, or changes made in connection to the bid by the City’s employees, agents or consultants unless in the form of a properly issued Addendum.
The failure of the bidder to contact the Owner to determine the issuance of any Addenda, or to acknowledge receipt of any and all of the Addenda issued in connection with this project, shall entitle the City, at its sole discretion, to (i) reject the bid as being non-responsive, or (ii) to accept the bid, in which event the bidder agrees to be bound by all of the terms and conditions of each unacknowledged Addendum.
Within ten (10) days after acceptance of this Proposal, the undersigned will execute the formal contract and will deliver an approved Surety Bond and such other bonds as required by the Contract Documents, for the faithful performance of the Contract. The attached bid security in the amount of 5% is to become the property of the Owner in the event the contract and bond or bonds are not executed and delivered within the time above set forth, as liquidated damages for the delay and additional work caused thereby.
The bidder assures that its employees and applicants for employment and those of any labor organization, subcontractors, or employment agency in either furnishing or referring employee applicants to the undersigned are not discriminated against.
The bidder agrees to begin construction within 10 calendar days after the issuance of the Notice to Proceed with Construction (Work Order). Substantial completion of the work will be achieved within 90 calendar days of the date indicated on the Notice to Proceed and final completion will be achieved within 30 calendar days after substantial completion.
Bidder certifies that by submitting a bid, he has the legal authority to bind the bidder, and further certifies that there are no objections to any of the terms and conditions listed in this bid document.
