Please note: This is a Sole Source Notification. The contract for M&O services with incumbent vendor Three Sigma expired on April 1, 2025. Because the SCWIC MIS is federally funded, the agency was legally prohibited from advertising or awarding any Sole Source procurement without prior FNS approval, as required by 7 C.F.R. § 246.14 and 2 C.F.R. § 200.320(c). Although the agency timely submitted its Sole Source request to FNS, FNS approval was not issued until July 14, 2025, creating a three-month gap during which the agency lacked legal authority to proceed with the Sole Source. The Emergency Procurement was therefore legally essential and mandatory to maintain WIC system operations until the FNS-approved Sole Source contract could be executed.
