● The Contractor shall furnish all labor, materials, equipment, traffic control, and supervision necessary to complete sidewalk repair and replacement work at various locations as directed by the city. ● The Contractor shall work closely and cooperatively with the City’s Project Manager and tree and stump removal contractors, to ensure work is completed in a timely manner and adequately documented to meet federal programmatic requirements. ● The Contractor must coordinate all work activities exclusively through the City-designated Project Manager, who will serve as the primary point of contact for all City contractors participating in the recovery effort. Contractors may communicate directly with one another as necessary to support efficient coordination, provided the City-designated Project Manager is kept informed. The City Project Manager shall be copied on all written correspondence and shall be made aware of all meetings and site visits related to the work. ● Work locations may include public rights-of-way, parks, municipal facilities, and other City-owned or City-maintained properties. All assignments will be issued through formal work order. o The Contractor is required to adhere to all relevant federal, state, and local codes, laws, and regulations, including but not limited to the Americans with Disabilities Act (ADA) and any funding-specific accessibility conditions. The City acknowledges that inadvertent deviations from ADA standards may occur during construction. Upon identification of a potential ADA non-compliance, the City, in its sole discretion, shall determine the appropriate course of action, which may include: ▪ Waiver of Non-Compliance: The City may elect to waive the identified noncompliance where permitted by law and funding requirements. Any waiver shall be documented in writing. The City’s ability to waive non-compliance shall be substantially limited or prohibited where the work is federally funded or otherwise subject to mandatory federal accessibility enforcement. ▪ Corrective Adjustment to the Work: The City may direct the Contractor to modify, adjust, or supplement the work to achieve compliance. ● The Contractor shall bear the cost of corrective work required to address errors, omissions, or misinterpretations of ADA requirements. ● No additional compensation shall be due for corrective work resulting from Contractor error. ● If corrective work reduces the scope, quantity, or functional value of the originally accepted work, the City may equitably adjust the Contract price to reflect the corrected condition
