6 The scope of work and services requested for this RFP include, but are not limited to, the items described herein. 7 The City’s Representative or designee will mark all trees scheduled for removal. 8 The Contractor shall not remove any tree without first confirming that the tree is marked for removal. Any confusion shall be resolved by contacting the City Representative. Errant removal of trees shall be penalized up to the cost of replacement. 9 Contractor is responsible for notifying Underground Service Alert prior to starting the work. Contractor is responsible for identifying and secure applicable permits related to utilities for the requested services. 10 Prior to commencing work, a pre-work field inspection with the City Representative or designee shall be conducted. 11 Prior to any work, each tree shall be visually surveyed from all sides to detect the presence of bird nests or wildlife. If nests or wildlife are found, the Contractor shall contact the City Representative. If a nest is active or wildlife is considered threatened/endangered, work shall not proceed without written permission from the City’s Contract Biologist. 12 Coordinate all work with the City to ensure compliance with pre-work biological surveys, regulatory permits, and site access constraints. 13 The Contractor is responsible for protecting all native trees and vegetation not scheduled for removal. 14 All work must comply with the Migratory Bird Treaty Act (MBTA), California Endangered Species Act (CESA) and Federal Endangered Species Act (ESA), and other applicable laws and regulations. The Proposer must confer with the City-supplied Contract Biologist for all maintenance and/or work occurring at any time during the calendar year and particularly from February 15 through September 15.
