1.1 General: The BENNETT project is intended to dramatically reduce or eliminate the hazardous potential of the following features which have been inherited from previous mining activities: 1. Dangerous Highwall 2. Impoundments 3. Dangerous Slide 4. Benches 5. Equipment and Facilities 6. Spoil Area 1.2 The CONTRACTOR shall install the Initial BMP’s and then perform any necessary clearing operations. Any hazardous water bodies or impoundments must be drained and backfilled prior to mass grading the site. Onsite spoil materials shall be used for backfilling the dangerous highwall, reclaiming the impoundments, benches, dangerous slide, and equipment and facilities, and grading the site as shown on the Construction Drawings. Compactive efforts shall be performed as detailed in these Contract Specifications. The CONTRACTOR should prioritize any earthwork related to constructing the required stormwater detention ponds or temporary basins. All areas disturbed by any construction activities must be revegetated, and any necessary final BMP’s shall be installed. 1.3 The project limits shall NOT be expanded without prior approval from the DEPARTMENT. All construction activities must be overseen by a competent SUPERINTENDENT who shall ensure that the work is performed in accordance with the Construction Drawings and these Contract Specifications. This SUPERINTENDENT shall carry out the instructions of the PROJECT MONITOR and shall be required to keep a copy of the Construction Drawings, Parts I and II of the Contract Documents, and a copy of the Spill Prevention, Control and Countermeasure (SPCC) Plan in their possession at all times. 1.4 All federal, state, and local laws, rules, or regulations governing any work performed on the site must be followed at all times. Any permits required during construction must be obtained by the CONTRACTOR or transferred into their name prior to commencing the permitted activities.
