1. This remediation project REQUIRES a proposed remediation plan prepared by a Professional Engineer registered in the State of Alabama in accordance with the requirements of ADEM Admin. Code r. 335-13-11-.03(4). All prospective bidders must submit, at a minimum, a basic, proposed remediation plan for the project using ADEM Admin. Code r. 335-13-11-.03 as guidance, along with their bid. The awarding of projects by the Department will be contingent on the adequacy of the proposed remediation plan submitted. 2. All bids submitted must be accompanied by a project cost estimate breakdown of the bid. 3. Once the project has been awarded, the contractor must start the project within ten (10) days of the award date and the project must be completed within ninety (90) days of the award date. The contractor must notify the Removals and Response Unit immediately if the project cannot be started or completed by the allotted dates. 4. The removal and proper disposal of all solid wastes, scrap tires, and scrap tire materials present on the site is required. Submittal of documentation showing proper disposal or documentation of approved beneficial reuse or recycling will be required for all materials removed from the site. Additionally, the site shall be closed in accordance with Division 13 Regulations and the approved remediation plan. 5. All required schedules (i.e. R & R Remediation Project Start Date Notification, R & R PostRemediation Inspection Request, and R & R Remediation Project Reimbursement Request, etc.) must be submitted using the Alabama Environmental Permitting and Compliance System (AEPACS) online portal for the site. 6. Three (3) "No Dumping" signs shall be install on the site at locations determined by the Department (contact the Removals and Response Unit for a copy of the sign template if needed). 7. Compliance with all local, State and federal laws and regulations during the entirety of the project, to include such work or documentation as may be required by Division 6 of the ADEM Administration Code. 8. No payment shall be made in advance of project completion. 9. All requirements of the contract must be adhered to for the entirety of the project. 10. The Department may utilize any and all processes available under State law for selection and project execution. 11. Liquidated damages for non-completion of work within the time limit agreed upon may be assessed in accordance with Department policy.
