Contractor agrees to provide to the Department of California Highway Patrol (CHP) Rainbow Commercial Vehicle Enforcement Facility (CVEF) Northbound, located at 1796 Rainbow Valley Blvd. West, Fallbrook, CA 92028 and Rainbow Platform Scales (PS) Southbound, located at Southbound Interstate15, Fallbrook, CA 92028, the services described herein: furnish all supplies, materials, tools, equipment, labor, personnel, and supervision; pay all taxes, insurance, bonds, license and permit fees, and all other direct and indirect costs necessary to provide Portable Chemical Toilet Rental Services, in accordance with the terms set forth in this Agreement. A. Contractor license requirement: • Local Business License • County Environmental Health Permit – issued by city/county • Disposal Site Discharge Permit • Motor Carrier Permit – issued by the Department of Motor Vehicles B. Contractor shall provide a Certificate of Insurance in accordance with the Insurance Requirements found in this Agreement (Exhibit E). 2. The services shall be performed at: Department of California Highway Patrol Rainbow CVEF, Northbound 1796 Rainbow Blvd. West Fallbrook, CA, 92028 Department of California Highway Patrol Rainbow Platform Scales, Southbound Southbound Interstate 15 Fallbrook, CA, 92028 3. The services shall be provided during: Services shall be provided during the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday, excluding State holidays. Contractor shall check in and out with the CHP on-site contact person or designee upon each service call to provide verification that service has been provided. SECTION A – GENERAL A. Contractor shall check-in with the on-site contact upon each service call to provide verification the service has been provided. B. Contractor shall comply with requirements of the Uniform Federal Accessibility Standards (UFAS) in that a wheelchair accessible portable toilet unit be placed on-site at each location. C. Contractor shall provide the following: o CVEF: One (1) American Disabilities Act (ADA) portable chemical toilet unit for rental, Two (2) regular portable chemical toilet units, and one (1) wash station all necessary chemicals and servicing to ensure they are clean and serviceable. o PS: One (1) American Disabilities Act (ADA) portable chemical toilet unit for rental, One (1) regular portable chemical toilet unit, and one (1) wash station all necessary chemicals and servicing to ensure they are clean and serviceable. D. Contractor shall provide all necessary paper products, liquid soap, and servicing to ensure they are clean and serviceable. E. Servicing shall be performed five (5) times per week. Contractor shall provide date stickers at each cleaning. F. All quotations for additional services not covered under this agreement are to be provided to the state at no cost by Contractor. G. Contractor shall keep portable toilets in good, clean, and safe operating condition, including washing all portable toilets inside and out (walls, floors, toilet seats, and ceilings) using Aqua-Kem cleaner or equivalent to ensure proper sanitation. H. Contractor shall refill each portable toilet to a minimum of (10) inches with a mixture of clean water and Aqua-Kem cleaner or equivalent product, with a ratio of chemical to water of 20/80. I. Contractor must add deodorizing liquid to each portable toilet tank. J. Contractor shall take all necessary precautions to protect service locations. Any damage caused by Contractor to state equipment, materials, or other priority shall be repaired by Contractor to the satisfaction of the state at no cost to the state. The state may, at its option, repair any damage and deduct from Contractor the cost thereof. K. Contractor shall pump out the holding tanks and properly dispose of waste in accordance with all Federal, State and local laws, rules and regulations. Additionally, the Contractor shall remove and dispose of all debris created during performance of services. L. Contractor shall deliver the waste to a county/city approved landfill in accordance with the state of California, Environmental Health Laws. The Contractor must meet the requirements of the Environmental Health Services Department and County Public Works Department of the county jurisdiction in which the removal and disposal of the waste material from the toilets. M. If Contractor shall be temporarily unable to provide services, the State, during the period of Contractor’s inability to provide services, reserves the right to accomplish the work by other means and shall be reimbursed by Contractor for any costs above the agreement rate. N. State shall not be liable for any damage incurred to the toilets while placed on state property. If any intentional or unintentional damage should occur to the toilets, it is the Contractor’s responsibility to replace or repair the toilet at no cost to the state. O. A service request requires a response by Contractor within twenty four (24) hours. PORTABLE TOILET UNIT A. Contractor shall provide Portable Toilet Unit(s) complying with requirements listed in this SOW. B. Contractor shall adjust grab bars upon delivery and at each service visit. C. Contractor shall adjust door closers (if provided) upon delivery and at each service visit. D. Contractor shall ensure sweep period from an open position of 70-degrees shall be no less than 3-seconds to move to a point of 3-inches from latch, measured to leading edge of door. (CBC 1133B.2.5.1) E. Contractor shall locate and secure portable toilet unit(s) as directed by the on-site contact.
