The COAH (Council on Affordable Housing) Counsel shall be an attorney at law in New Jersey. The COAH Counsel shall represent the Borough in all judicial and administrative proceedings involving or before COAH or otherwise involving affordable housing matters, such as builder’s remedy litigation, in which the Borough or any of its officers or agencies may be a party or have an interest. The COAH Counsel shall give all legal counsel and advice concerning affordable housing matters to the Mayor and Council, or any member thereof and shall, in general, serve as the legal advisor to the Borough Council and Administrator on all affordable housing matters of concern to the Borough. In addition, the COAH Counsel may be asked to work in cooperation with other Borough Professionals, as needed, in the preparation and/or revision of the Borough’s Fair Share Plan, ordinance(s) relating to affordable housing obligations and requirements, petitions for substantive certification or amended substantive certification, etc.
