1. Material – a. The crushed limestone shall – i. be available for purchase in Size 1A and/or Size 1ST; as specified herein. ii. meet NYSDOT Gradation Table 703-4. iii. be material derived from a NYSDOT approved source. b. The contractor shall set aside a stockpile at its plant site exclusively for testing and purchase by Steuben County. c. The contractor shall not add material to a stockpile which has been tested. 2. Testing – a. The County shall take and test samples from the stockpile in order to determine compliance with NYSDOT specifications (specified herein). b. Delivery of material from a stockpile shall not be made until said stockpile has been tested and approved. Note: Test results require approximately ten (10) days from sampling. c. Re-testing of delivered material – i. Initial test results notwithstanding, the County reserves as its right, the right to re-test material delivered to its site(s). Further, the County reserves as its right, the right to reject material which has been delivered but which does not pass a re-test. ii. Unless otherwise directed by the Commissioner or his designee, the contractor shall be required to immediately remove rejected material from the site(s). Said removal of material shall be solely at the expense of the contractor. Steuben County shall not pay the contractor for material which has been rejected.
