The CONTRACTOR shall manage, operate and maintain the Project in a manner that is both residentially and commercially reasonable, and in the best interest of the tenants subject to (a) applicable governmental requirements and (b) the terms and provisions of this Agreement. The CONTRACTOR shall keep the Project clean and in good repair at all times. The CONTRACTOR shall procure, manage, and supervise any services and contracts necessary for the maintenance, repair, and ongoing operation of the Project, as required to uphold the aforementioned standards. The CONTRACTOR shall be responsible for the preparation of all rental agreements and execution, in its name, identified thereon as agent for the City. The rental agreement shall be in a form approved by the City. Once approved, individual rental agreements need not be submitted for the approval of the City. Upon availability of a unit, the CONTRACTOR shall be responsible to draw up the rental agreement, to include, but not limited to, start end dates, rental rate, and parking fee, if applicable. The CONTRACTOR shall take actions as may be necessary to comply promptly with any and all governmental orders or other requirements affecting the Project, whether imposed by Federal, State, or County authority. Nevertheless, the CONTRACTOR shall take no such action so long as the CITY is contesting, or has affirmed its intention to contest, any such order or requirement. The CONTRACTOR shall notify the CITY in writing of all notices of such orders or other requirements immediately upon receipt. 2. Maintenance and Repairs. a. b. C. d. e. Janitorial Services and Refuse Collection. The CONTRACTOR shall maintain the common areas of the premises, including but not limited to, any landscape and plantings, parking spaces, and sidewalks within the Project in a clean and safe condition. The CONTRACTOR shall be responsible for any trash consolidation. The CONTRACTOR shall continuously assess the use of in-house Project personnel versus contract vendors and provide for the most effective and economical management of the Project. The CONTRACTOR shall be responsible for refuse collection. Routine Maintenance/Repairs. The CONTRACTOR shall be responsible for performing and/or paying for all routine maintenance/repairs required as Project costs. The CONTRACTOR shall develop a schedule of all routine maintenance activities for the CITY's approval. The CONTRACTOR shall respond to all tenant requests for service or repair as soon as possible but not later than two (2) working days after the requests are received.
