General Requirements: The contractor shall provide toilet tissue core materials for the state agency in accordance with the provisions and requirements stated herein and to the sole satisfaction of the state agency. The contractor shall understand and agree that the purpose of the contract is to obtain a supply of toilet tissue core materials on an as-needed, when-needed basis and the contractor shall conduct all contract responsibilities consistent with this purpose. Contractor’s Obligation: Unless otherwise specified herein, the contractor shall furnish all material, labor, facilities, equipment, and supplies necessary to provide the products required herein. QVL Utilization and Requirements: The state shall establish a QVL for the line items stated herein. Once established, the QVL will identify the contractors that may participate in responding to the quoting process stated herein. QVL contractor price quote requests shall be developed by the state agency to secure toilet tissue core materials. See section 2.3 for information describing the quoting process. Upon the state agency’s request for price quote(s) for a particular line item, the state agency shall notify ALL of the QVL contractors for the particular line item and request submittal of a competitive price quote response in accordance with the provisions herein. All terms and conditions of the contract shall apply to all QVL contractor price quote requests. The contractor shall understand and agree that determination of price quote specifications for each price quote request shall be made by the state agency. In the event the QVL contractor determines the QVL contractor no longer has the ability to source line items the QVL contractor was originally awarded, the QVL contractor may request in writing to the Division of Purchasing to remove the line items from the QVL contractor’s list of available products the QVL contractor may respond to price quote requests on. If the QVL contractor’s request is approved by the Division of Purchasing, a formal contract amendment will be issued by the Division of Purchasing in order to remove the QVL contractor’s ability to source the items. If the QVL contractor is later able to source other products from the RFP that the QVL contractor did not originally propose, the QVL contractor may request to be added to other toilet tissue core materials line items by submitting a written request to the Division of Purchasing. If the request is approved by the state agency and the Division of Purchasing, a formal contract amendment will be issued by the Division of Purchasing in order to authorize the QVL contractor to price quote and supply the toilet tissue core materials in addition to those originally accepted at time of contract award. Likewise, as the QVL contractor determines that the QVL contractor’s ability to source line items the QVL contractor originally proposed has significantly decreased, the QVL contractor may request to be removed from a line item by submitting a written request to the Division of Purchasing. If the request is approved by the state agency and the Division of Purchasing, a formal contract amendment will be issued by the Division of Purchasing in order to remove the QVL contractor’s authorization and obligation to price quote and supply the specific toilet tissue core materials from the list of line items originally accepted at time of contract award.
