When requested by the County through the Office of the County Attorney, the successful firm(s) shall render legal advice and provide representation to designated complainants in fair housing cases, as follows: 4.1.1 Provide representation in appellate proceedings when the complainant is the appellant regardless of whether the trial court ruling originated from state or federal court or from an administrative hearing. 4.1.2 The successful firm(s) shall be solely responsible for final decisions regarding legal advice and representation of complainants. 4.1.3 Following consultation with the County, the successful firm(s) shall make the final decision as to whether an unfavorable trial court ruling from state or federal court or administrative hearing warrants further appeal. 4.1.4 The successful firm(s) shall be sole signatory to all pleadings and papers filed in appropriate judicial or administrative forums. 4.1.5 Pertaining to matters in which an individual complainant’s interests and the interest of the County in enforcing the fair housing provision of Chapter 15, Article III of the Palm Beach County Code are merged, the firm(s) shall also represent the County’s interest in conjunction with the individual complainant’s action. 4.1.6 Should the interest of an individual complainant differ from those of the County, the firm(s) shall continue to represent the individual complainant’s interests and will refer representation of the County interests back to the Palm Beach County Attorney’s Office for further action.
