The Contractor will provide comprehensive legal services to the PUCT in all PIA appeals involving records not related to the Texas Energy Fund. The PUCT has engaged a separate Contractor to handle all PIA appeals involving records related to the Texas Energy Fund through a separate contract. Without limitation, the Contractor will be responsible for: (1) Initial case review and preparation, to include review of all records, written documents, briefs, exhibits, and OAG letter rulings and/or decisions. (2) Identification of potential legal errors and arguments in favor of appeal. (3) Identification of potential legal issues and arguments against appeal and recommendations to PUCT Staff about pursuing appeal. (4) Drafting petitions for relief, to include petitions for declaratory order, petitions for injunctive relief, and all appellate documents. (4) Drafting comprehensive appellate briefings outlining the issues, facts, legal arguments, and requested relief (including initial briefs and reply briefs). (5) Researching relevant case law, legal statutes, prior OAG letter rulings, decisions, and prior determinations. (6) Responding to opposing parties’ correspondence, briefs, and arguments. (7) Oral argument preparation, including developing key points and anticipated questions for oral argument. (8) Attending all hearings as required. (9) Communicating with PUCT staff regularly about status of cases and progress of appeals. (10) Prompt response to all PUCT inquiries.
