The City Hearing Officer shall be appointed by the City of Kissimmee City Commissioners (the “Board”) and shall serve at the pleasure of the Board. 1.) The City Hearing Officer shall conduct public hearings of contested red light camera notices of violation, parking violations, and noise violations for the City as needed, make findings of fact based upon the evidence of record render decisions, execute judgments, and ensure fundamental due process is observed (hereinafter “Services”). The City Hearing Officer shall provide Services in accordance with the provisions of Section 316.0083, Florida Statutes, and Chapters 22 and 42, City of Kissimmee City Code. If the City implements a school zone speed detection system pursuant to Sections 316.008(9)(a), 316.0776, and 316.1896, Florida Statutes, the City Hearing Officer shall conduct public hearings of contested notices of violation for Section 316.1895 regarding excessive speed in a school speed zone. 2.) The City Hearing Officer shall be an attorney who is admitted to the Florida Bar and possesses experience and a working knowledge of Section 316.0083, Florida Statutes, Chapters 22 and 42, City of Kissimmee City Code, administrative law, and the law of evidence. 3.) Pursuant to City Code section 42-22, the City Hearing Officer has jurisdiction to hear violations of red-light camera notices of violation, parking violations, and noise violations issued by the City 4.) City Hearing Officer hearings will be held at City Hall, which is 101 Church Street, Kissimmee Florida 34741. 5.) The anticipated hours should not exceed ten (10) to twelve (12) hours per month. 6.) The City Hearing Officer shall not serve in more than one office in violation of Article II, section 5(a) of the Florida Constitution.
