The Scope of Work may include, but is not limited to, the following Landscape Contractor Services: A. Maintaining Required Certifications and Licenses B. Bonds and Insurance • Provide insurance coverage that meets or exceeds the minimum requirements as set forth in the Agreement. Insurances shall remain in effect during the term of Agreement. • Contractor shall be fully licensed and insured to provide Landscape Contractor services in the City of St. Petersburg, Pinellas County, Florida. • In addition, provide Builders Risk Insurance for road right-of-way landscape projects. Coverage shall include but is not limited to repair and replacement of materials damaged by errant vehicles, storm damage, wind, flooding or theft during construction and the Establishment Period until Final Acceptance of the project by the City. Builder’s Risk insurance shall remain in effect for the entire term of each project assignment awarded to the Contractor. • In addition, provide a Public Construction Bond for 100% of landscape services projects exceeding $50,000. The City reserves the right to request or waive bond requirements for projects valued at less than $50,000. Sufficient bonding capacity with required bonding company rating must be available for each project assignment awarded to the Contractor. C. Conformance with Federal, State and Local Requirements • The Contractor shall maintain all minimum requirements throughout the term of the Agreement. The Contractor shall provide updated documents to the City upon renewal of certifications and licenses. The City reserves the right to request certifications and licenses periodically for work performed under this agreement. Requests will be made to the Contractor’s account manager and shall not relieve the Contractor of responsibility for compliance with all Federal, State and local regulations. • Comply with Federal Labor Standards Provisions and Davis Bacon Act requirements when required for Federally funded projects. • Living wage, disadvantaged worker, and apprenticeship ordinances do not apply to projects that involve the expenditure of State or Federal assistance or contract funds. The City shall comply with State or Federal law and authorized regulations which are mandatorily applicable, including those which dictate that certain provisions may not be required on a particular project.
