The State of California (State), Department of General Services (DGS), Office of Business and Acquisition Services (OBAS), Natural Gas Services Program (NGS), notwithstanding any other law, the director shall operate the NGS to consolidate and address the needs of multiple state agencies for the procurement of natural gas and related services, pursuant to Public Contract Code Section 10299.1. NGS is procuring services for natural gas supply in Southern California, in accordance with the North American Energy Standards Board (NAESB) Base Contract. The Bidder shall provide OBAS NGS all labor, equipment, and materials required to provide Natural Gas Services, in accordance with the NAESB Base Contract, as described in the Sample Agreement, IFB Attachment 9. The State anticipates a 36-month term for this Agreement. DGS reserves the right to extend the contract term for up to two (2) additional one-year extensions at the contracted rates. Any contract extension shall be mutually agreed upon by the Contractor and the State. Upon DGS approval of contract, gas transactions may commence immediately for gas flow at contract start date. Any forward gas purchases made with terms longer than the noticed termination date shall continue as specified in the Transaction Confirmations. DGS may terminate this Contract effective as of June 30 of any year by notice to the Supplier prior to April 1 of that year. If DGS elects to terminate this Contract, executed Transaction Confirmations shall continue in force until their expiration.
