Part 1 – Pre-Construction Services: Part 1, Pre-Construction Services, will be performed for a stipulated or fixed amount and will be subject to the Contract Between Virginia Tech and CM for Part 1 – Pre-Construction Services (Form HECO-9 – CM (1)), the Virginia Tech RFP General Terms and Conditions for Part 1 Pre-Construction Phase Services Contract, and all additional documents identified these two documents (the “Part 1 Contract”). The Part 1 contract is associated with the work of the CM at Risk prior to the start of construction activities. Part 1 Pre-Construction Scope of Services shall include the following: 1. CM at Risk Pre-Construction Scope of Services described in the RFP. See Appendix A. 2. All Part 1 Scope of Services shall comply with the requirements of the Part I Contract attached hereto as Appendix A-1 and the VT Manual. Part 2 – Construction Work: Part 2 Construction Work is contingent upon the CM submitting an acceptable GMP to Virginia Tech and Virginia Tech accepting and agreeing to a Guaranteed Maximum Price (“GMP”) from the CM. If Virginia Tech does not accept the CM’s GMP proposal, the Part 1 Contract will be concluded and Virginia Tech will not enter into a Part 2 Contract with the CM. If Virginia Tech moves ahead with Part 2 Construction Work, the construction work will be subject to the Contract Between Virginia Tech and CM At Risk for Part 2 – Construction Phase Services (Form HECO-9 – CM (2)); the current version of the Virginia Tech General Conditions of the CM At Risk Construction Contract (Form HECO-7CM); and all additional documents identified by these two documents including, but not limited to, VT Manual, Supplemental General Conditions and Special Terms and Conditions (the “Part 2 Contract”). Part 2 services shall include the following: 1. Completion of the Construction portion of the Work in conformance with the project documents and the Construction Phase Scope of Services listed in RFP Appendix B. 2. All Part 2 Scope of Services shall comply with the requirements of the Part 2 Contract and the VT Manual.
