2024 ANNUAL TOTALS Criminal Charges Filed 2,545 Contempt Charges Filed: 788 DWI Cases Filed: 324 Suspended/Revoked DL Cases Filed: 247 Competency Cases 11 BREAKDOWN of CASES ASSIGNED (percentage) Criminal Petty Misdemeanor: 50% DWI: 30% Suspended License: 20% COURT/PUBLIC DEFENDER SCHEDULE Pretrial conferences are held every other first and third Thursday starting at 2:00 p.m. Sentencing hearings are held every second and fourth Wednesday starting at 3:00 p.m. Other additional hearings/times conducted as necessary with Tuesday morning given the priority and Thursday morning given the second priority. 1. The Offeror must provide all services for representation of indigent defendants in the Farmington Municipal Court who may be sentenced to incarceration or whose conviction on the pending charges may result in mandatory incarceration for future convictions. 2. The Offeror must assure that all indigent persons meeting the above guidelines appearing before the court are properly represented. 3. The Offeror must provide all necessary materials, supplies, equipment, and services required to represent indigent defendants. 4. The services offered by the successful Offeror must be effective, efficient and courteous at all times. 5. The services will also include representation of those defendants for whom competency has been raised. Offeror will be expected to be familiar with New Mexico Statutes Annotated, Chapter 31, Article 9, labeled Mental Illness and Competency. Representation will include appearing in District Court for all scheduled appearances, trials and hearings. Representation will include responding to inquiries and facilitating client appointments with authorized state health providers to perform Competency Evaluations. Representation will also include considering all information, statements, and reports that concern competency in preparation of legal arguments, procedural requirements and standards of proof. Estimated between 15 to 20 cases per year. 6. The Offeror shall be responsible for any cost associated with their case preparation and presentation including but not limited to: private investigation, expert witnesses, non-trial interpreters, etc. 7. Number of attorneys available to provide services: i.In order to provide continued services, a minimum of two attorneys must be included in your Offer. ii.Two attorneys will be required to participate on Pre-Trial court days to provide for effective and efficient services, as well as expedite the trials of the court. iii.Subcontracting of additional attorneys is acceptable, however, the information for attorneys that will complete the services must be submitted with the Offer. iv.If subcontracted attorneys will be utilized, and in order to receive any preference points, applicable preference certificates for the subcontractor(s) shall be submitted with the Offer. v.Future substitutions and the addition of attorneys after the award of the proposal is subject to approval by the City.
