The Work under this Contract is to provide all necessary labor, parts, materials and equipment for the maintenance and repair of HVAC equipment. A. A list of equipment/assets to be serviced under this Contract is included in Exhibit A. This list is included for bidding purposes only and may not be complete or accurate. The Contractor shall verify the necessity of repair work for the listed equipment as directed by DEP Project Manager and/or facility managerial staffs. DEP may add or delete equipment, within the specified facilities, where Work can occur over the course of the actual performance of this Contract. B. The Contractor shall arrange with the DEP Project Manager to have existing DEP equipment taken out of service (e.g., lock-out/tag-out, etc.), if necessary, for the performance of Work under this Contract. The Contractor shall have no authority to remove any equipment from service except under emergency conditions, where a reasonable belief exists on the part of the Contractor that continued operation of the equipment may cause personal injury and/or property damage. In the event of such emergency, the Contractor shall immediately notify the DEP Project Manager and the responsible DEP official in charge of the facility where the Work is taking place. C. All Work shall be performed in strict accordance with the latest instructions of the original equipment manufacturer(s) (OEM). The Contractor shall have its own access to all original equipment materials lists, electrical and manufacturing specifications, drawings, critical dimensions, tolerances, etc., as well as any special operating and maintenance instructions or information necessary to service and repair the equipment. D. The quantities described in these Specifications and/or on the Bid Schedule of Prices for the Work to be provided during the term of the Contract are only estimates. While the bid and subsequent award of this Contract will be based on these estimates, the Contractor is advised that this is a “when and where” contract and that DEP, at its sole discretion, shall have the right to increase or decrease the quantity of Work to be provided. DEP reserves the right to have the Work performed by others. DEP is not required to order any Work under this Contract. In the event that no Work has been ordered at the expiration of the Contract, DEP will pay to the Contractor the sum of One Thousand Dollars ($1,000.00). E. The Contractor shall respond to all maintenance and guaranty requests pursuant to Article 18 of the Supply and Service Contract within twenty-four (24) hours of notification by the DEP Project Manager.
