The City of Fairhope is requesting responses from contractors to provide and deliver twelve (12) natural gas bypass pumps for City of Fairhope Water/Wastewater Department Lift Stations. Bidder must provide delivery date for items. City reserves the right to award based on lowest responsive bidder that can deliver within the within the listed delivery window. Firms submitting proposals are solely responsible for meeting submittal deadlines. Proposals received after the stated deadline will be deemed non-responsive and will not be considered for any contract awarded as a result of this solicitation. Proposals deemed responsive will be evaluated and an award decision will be made by the City Council. A contract will be awarded to the qualified applicant whose proposal is determined to be the most advantageous to the City of Fairhope. The City reserves the right to reject any or all proposals, and to waive any irregularities or informalities in the proposal process. This is a Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2010 (“RESTORE Act”) Grant Funded Capital Improvement Project. Any contract resulting from this solicitation will be subject to the terms and conditions of the Sub-Award Agreement between the Alabama Department of Conservation and Natural Resources (“ADCNR”) and the Project Owner, the terms and conditions of the Federal Award from the Gulf Coast Ecosystem Restoration Council, including any Special Award Conditions, the ADCNR Sub-Award Terms and Conditions, the RESTORE Act Financial Assistance Standard Terms and Condition and Program-Specific Terms and Conditions under the “Spill Impact Component,” as amended, the RESTORE Act, 33 USC § 1321(t) et seq., the U.S. Department of Treasury Regulations governing the RESTORE Act, 31 CFR § 34 et seq., all applicable terms and conditions in 2 CFR Part 200 of the Office of Management and Budget (“OMB”) Uniform Guidance for Grants and Cooperative Agreements, as amended on August 13, 2020, including Appendix II to 2 CFR Part 200, and all other OMB circulars, executive orders or other federal laws or regulations applicable to the services provided under this contract. All of these terms and conditions apply to the Subrecipient and its Contractors, as well as any covered subcontractors or vendors whose work is funded as a result of this solicitation.
