3. Contractor Requirements A. Contractor shall provide original equipment manufacturer (OEM) products. Products must be new, not refurbished or in used condition. B. Contractor shall not require a minimum quantity and/or cost per order. County does not intend to place multiple small orders, but orders will be placed on as needed basis. C. Contractor shall only supply items specified within this Contract. D. Contractor shall provide delivery lead time notification after each order has been placed. Any delays must be notified immediately to the County. E. Urgent/Rush Orders 1. Contractor shall provide emergency/rush services on any order request classified by County authorized personnel as such. 2. Contractor shall provide written quote for any rush fees. F. Returns 1. Contractor shall not charge any restocking fees to any items being returned for any incorrect items. 2. Contractor may choose to pick up items/products being returned or send a pre-paid return label to return package at no cost to the County. A credit for returned items shall be issued within thirty (30) business days of notification. 3. Contractor shall process returns made within fifteen (15) business days of delivery under any of the following circumstances: a. Items/Products ordered are received with visible or noted damage in shipment and/or delivery. b. Items/Products ordered are received with concealed damage in shipment and/or delivery. c. Items/Products are incorrectly shipped. d. Items/Products received is late or delayed and because of the late or delayed delivery is deemed in good faith by the County to be unusable or no longer needed.
