1. Delivery & Packaging Requirements: Delivery shall be made within twenty-four (24) hours after orders are placed. The Contractor shall inform the County immediately if delivery is expected to exceed this timeframe or if complete order cannot be delivered. The Contractor shall notify the County when anticipated orders are to be delivered. Each delivery shall include by an itemized delivery ticket. Delivery tickets are to include: the date of delivery; ticket number; description of the product, package number; quantity/unit and total price for each item; delivery location; contract number; when applicable, the purchase order number; and signature of the authorized County representative accepting the order. The County will accept partial deliveries so long as the delivery ticket reflects the actual items delivered. Modifications to the delivery ticket are not acceptable. 1. Acceptance of Product: The Contractor shall retain control of all goods until they are delivered and acceptance has been made. All risks of transportation and related charges shall be the responsibility of the Contractor. All claims for visible or concealed damage shall be filed by the Contractor. Fleet Services will notify the Contractor promptly of any damaged goods and assist the Contractor in arranging for inspection and return. 2. Delivery Location: County of Prince George, Fleets Department, 6509 Laurel Spring Road, Prince George, VA 23875. 3. Hours of Delivery: All deliveries shall be between 7:30 a.m. and 3:30 p.m., Monday through Friday. The County reserves the right to refuse delivery attempts outside of this timeframe. 4. Packaging: Products shall be delivered in bulk, drums, gallons, quarts, and tubes. All lubricants shall be packaged and delivered in accordance with applicable Federal, State, and Local specifications, standards, requirements, and regulations, and in containers as specified herein. The County will not accept deliveries packaged incorrectly and/or inappropriately. 5. Drums/Pallets: Drums/pallets shall be provided at no additional cost to the County. Drums/pallets shall be delivered in satisfactory condition, with drums having minimal dents and rust free. Unsatisfactory drums/pallets shall be rejected upon delivery with replacement required within twenty-four (24) hours at no additional charge to the County. Empty drums/pallets shall be picked up upon delivery of orders. Scheduling of deliveries and pick-up of drums/pallets shall be coordinated with the County. Final pick-up of all empty drums/pallets shall be made within even (7) business days of expiration of contract. 6. Spillage: The County assumes no responsibilities associated with product spillage. The Contractor shall be responsible for all spillage resulting from delivery and unloading of lubricants. Remove and transport the debris in a manner that prevents spillage on streets or adjacent areas. Apply local regulations regarding hauling and disposal. 7. Returns: Products delivered that were not ordered by the County will be returned to the Contractor at no additional cost to the County. The Contractor shall pick up the incorrect products on its next regularly scheduled delivery, or no late than seven (7) days after notification by the County, whichever occurs first. Credit shall be issued in the amount of the original acquisition cost. a. Items delivered that are defective shall be picked up by the Contractor at no additional cost to the County. The Contractor shall replace the defective item on the next regularly scheduled delivery after notification by the County. b. No restocking fees shall be assessed on regular orders placed by the County. Restocking fees may be applied to special ordered items, or items ordered incorrectly by the County. Restocking fee for such orders shall not exceed 10% of the original acquisition cost. c. The County reserves the right to return any obsolete or overstocked products once annually. Returns shall occur on a mutually agreed upon date. Credit shall be issued at actual acquisition cost with no restocking fees. 8. Cancellation of Order(s): Purchases through the contract are for readily available products. Time is of the essence in furnishing the items ordered. The County reserves the right to cancel the order and/or refuse delivery if the Contractor fails to deliver the products ordered within the period of time specified herein.
