4.2.1.1 Respondent will maintain a staff of properly trained and experienced employees, agents, and subcontractors (collectively, “personnel”) to ensure satisfactory performance of the Work. Respondent will cause all personnel directly in charge of the Work to be duly registered and/or licensed under all applicable federal, state, and local, laws, regulations, and ordinances. Respondent will designate a representative who will be responsible for the administration and coordination of the Work. Respondent will furnish efficient business administration and coordination and perform the Work in an expeditious and economical manner consistent with the interests of UTMB. 4.1.1.2. Respondent’s personnel performing the Work will be competent and experienced in the field of emergency generator maintenance and repair and have with a minimum of eight (8) years’ experience on equipment comparable to that listed in Attachment C – Pricing Schedule. Respondent is responsible for all costs associated or related to performance of the Work in accordance with requirements of this Contract. 4.1.1.3. Respondent will cause its personnel performing the Work to read this Contract and be fully knowledgeable about the Work. 4.1.1.4. Any Respondent personnel, who violates this Agreement or fails to perform his or her duties in accordance with this Agreement, shall be replaced upon the request of UTMB.” 4.1.1.5. A Security Clearance Check must be performed for each of Respondent’s personnel performing Work on UTMB’s premises. The type and scope of the Security Clearance Check is indicated in the Respondent’s Security Clearance Requirements in Attachment D – Security Clearance Requirements. 4.1.1.6. Respondent personnel will be required to perform work in the Texas Department of Criminal Justice Hospital (TDCJ) and the Galveston National Laboratory (GNL) and are therefore subject to additional clearance requirements than those required by UTMB’s standard security clearance check. 4.1.1.7. Respondent represents, warrants and agrees that (a) it will use commercially reasonable efforts to perform the Work in a good and workmanlike manner and in accordance with commercially reasonable standards of Respondent’s profession or business, and (b) all of the Work to be performed will be of the quality that prevails among similar businesses engaged in providing similar goods and services in major United States urban areas under the same or similar circumstances. 4.1.1.8. Respondent will keep the jobsite free of debris and in a safe condition throughout the performance of the Work. Respondent will clean the area when the Work is complete. 4.1.1.9. Respondent will use only new parts and supplies in accordance with the applicable equipment manufacturer’s specifications, unless otherwise authorized by Project Manager or authorized UTMB representative.
