1. Assist ACC with implementing its Construction Wages and Workforce Conditions Program. If applicable, propose optional additional services as recommended to further develop and implement the Program; 2. Assist and advise ACC staff in the preparation and updating of contractual labor compliance requirements, and recommend changes to such provisions in construction solicitations and contracts; 3. Advise regarding past prevailing wage violations by contractors and subcontractors; 4. Attend pre-construction meetings for all projects and provide contractors and their subcontractors with information and materials about labor standards and wage and reporting compliance requirements; 5. Monitor labor standards provisions as required for ACC construction projects under the Program; 6. Ensure Occupational Safety and Health Administration (OSHA)-10 certification for all workers on-site, and OSHA-30 certification for all safety supervisors for all projects under the Program; 7. Provide assistance to ACC’s Internal Auditors in their oversight function to ensure that all workers employed by ACC’s contractors and their subcontractors are hired and paid in compliance with all applicable state and federal labor standards and the terms of the Program; 8. Provide on-site monitoring, as required, to implement the Program including, but not limited to: • Site visits that must include a minimum of two (2) bilingual monitors who are fluent in both English and Spanish languages; • Site visits will take place at a predetermined time, for a minimum of one (1) hour, and shall be scheduled in coordination with ACC's Facilities and Construction (F&C) Project Manager, or designee; • Bilingual monitors will conduct bi-weekly site visits for every project;• Bilingual monitors will randomly survey workers on-site, via a questionnaire based on all requirements of the GO Bond Program and the pertinent Better Builder® Program, (or equivalent), requirements. Monitoring requirements must include, but are not limited to: Minimum wage/Davis-Bacon wage rates, Safe work conditions, OSHA training certifications, United States Department of Labor (DOL) apprenticeship program participation, etc.; • Safety walks must be performed by the monitors during each site visit. Imminent dangers must be reported immediately, (verbally and in writing), to ACC's General Contractor's Safety Representative, and to ACC's F&C Project Manager. Additionally, any safety concerns and/or risk-mitigation issues must also be reported, (verbally and in writing), to ACC's General Contractor's Safety Representative, and to ACC's F&C Project Manager; • All wage and safety issues that do not pose an immediate safety threat must be reported to ACC's General Contractor's Safety Representative, and to ACC's F&C Project Manager, following each visit; 9. Conduct field interviews, as required, to implement the Program; 10. Inform ACC and affected contractors/subcontractors immediately regarding issues of compliance with the Program or with state and federal standards; 11. Suggest revisions or modifications to the Program, as applicable; 12. Identify Program violations and if requested by ACC, assist ACC or its Internal Auditors with investigations of complaints of underpayment to workers; 13. Assist ACC in reporting suspected violations of the prevailing wage law to the contractor; 14. Provide a dedicated worker hotline for workers to report wage and safety issues. The dedicated worker hotline number must be clearly posted in signage located throughout the designated project sites, and signage must be available in both English and Spanish languages; 15. Provide monthly reports for each project detailing the safety and wage findings for the month; 16. Join the General Contractors' already established all-site safety meeting if possible; 17. Oversee Toolbox Talks, at least once per quarter; 18. Review the final project report file and participate in the final review meetings; and, 19. Other necessary labor compliance monitoring services as requested by ACC.
