The selected Consultant shall be capable of self-performing a minimum of 50% of the overall professional services provided during the term its agreement with the County. Additionally, the selected Consultant shall be capable of providing by all means necessary and able to deliver County Road Right-of-Way Services that includes but is not limited to Property Valuation Appraisal Services, Property Acquisition Services, Pre/Post Project Preparation Services, Court Coordinator Services, Valuation Specialty Services, and all required Property Legal Services requiring administration and oversight of an Attorney. In the event that the selected Consultant becomes unable to settle and procure a specific right-of-way parcel or tract and after exercising all reasonable efforts to negotiate the successful procurement of the specific right-of-way parcel or tract and after further exhausting all reasonable efforts including industry best practices and all contract requirements to negotiate the successful procurement of the specific right-of-way parcel or tract, the Consultant shall notify the County with a written comprehensive explanation of the situation. The County Attorney will review the Consultant’s explanation to determine the best course of action up to and including condemnation of the specific right-of-way parcel or tract. Due to specific internal procedures the County will handle all action specific to condemnation proceedings. The selected Consultant will have the opportunity to contract with the County for a period of no more than three (3) consecutive years form the date of contract execution.
