Contractor agrees to the following: a. Contractor shall provide the fuel, labor, and equipment necessary to carry out the bailing of hay and terms of this agreement including, but not limited to mowers, rakes, balers, tractors, trucks and trailers to cut and bale grass hay in the designated area as indicated on the attached Exhibit A and provide an accurate account of bales produced. It is anticipated that there will be at least one cutting per year. The timing of all cuttings will be coordinated with approval from Daviess County Solid Waste. b. Any cutting will be at least thirty (30) days after application of bio-solids per regulations. c. All bales will be removed from the property (or the County’s share from the field) within 30 days of baling, depending upon weather conditions. At no time shall hay be left in bales or stacked in any form in the common roadways around the Daviess County Fiscal Court property, or in a manner that limits safe free travel on common roadways. d. Contractor shall communicate with the Daviess County Solid Waste Manager on hay operations throughout each year e. Contractor will incorporate best management practices in the cutting, raking, baling, and removal of the hay crop the assure the crop is removed fully an efficiently without unnecessarily damaging surface. f. Contractor shall obtain access to West Daviess County Landfill premises only through designated gates by the Highway 815 entrance and must abide by all regulations pertaining to the safe operation of West Daviess County Landfill. Keys will be provided to Contractor to access the gate, and the keys must be returned to West Daviess County Landfill upon the conclusion of this Agreement. All gates must always remain secured unless contractor is entering or exiting the gate. Contractor shall only access the premises during the haying season for the purpose of harvesting hay on the property, and is not permitted under this Agreement to access the premises for any other purpose without first receiving permission from the Daviess County Fiscal Court.
