1. Contractor agrees to furnish all labor, equipment and materials, at its sole expense, to operate and maintain a solid waste transfer station (“Transfer Station”). The Contractor shall operate and maintain the transfer station and scales during the term of this agreement according to the general accepted solid waste transfer station standards. 2. Contractor shall remove all waste as soon as practicable and shall promptly move to a disposal facility all Solid Waste transferred into tractor trailers in the Transfer Station upon reaching capacity in each tractor trailer used therein. In no event shall waste be allowed to remain at the Transfer Station for more than three days unless required by applicable law. 3. Contractor shall dispose of all solid waste at a permitted Landfill. Proposals shall specify the landfill(s) and include copies of current permits where solid waste from Catoosa County will be disposed of by Contractor. 4. Contractor agrees that in no event shall the boundary of the Transfer Station Site exceed the limits of the tract (Lot 2 ~7.776 Acres) as seen in Attachment C. 5. Contractor shall maintain all roads running in and over the Transfer Station which it uses in connection with the Transfer Station including access into the Transfer Station Site by citizens of the County. The County shall maintain one access road to the entrance of the Transfer Station Site. This road shall be maintained in a manner which is suitable, in the discretion of the County, so as to permit access from the public road to the Transfer Station Site including normal wear and tear. No additional public roads shall be required to be constructed by the County, nor shall the County be obligated to improve any public roads which lead to the Transfer Station Site beyond reasonable wear and tear. 6. Contractor shall refuse to accept Solid Waste from haulers of waste to the Transfer Station that repeatedly refuse to comply with County ordinances with respect to covered loads and state laws with respect to safety
