1. Appointment of Attorney. A Special Counsel may be appointed by the Mayor and Council as provided in local ordinances for calendar year 2025. The term of appointment for the position of any Special Counsel shall be a term of one (1) year. The Mayor and Council may appoint one or more attorneys to serve as Special Counsel. Special Counsel shall be selected and appointed in a manner consistent with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. The Mayor and Council may appoint an individual or a firm of attorneys. If the proposer is a firm of attorneys, an individual attorney of the firm meeting the minimum qualifications set forth herein must be identified as the specific individual who will be assigned to the service. No substitution may subsequently be made for that individual attorney without the express written consent of the Township and then only for unusual or exigent reasons. 2. Duties and Responsibilities. Special Counsel shall provide representation to the Township of West Caldwell, as needed, in case where a conflict is present or specific experience or expertise is desired on various matters that may arise during the contract year, including but not limited to the following areas of law: general municipal law, affordable housing, the Open Public Records Act, the Open Public Meetings Act, Local Public Contracts Law, bankruptcy, labor and employment, public contracting, real property taxation and assigned special litigation, etc. Special Counsel shall represent the Township as directed by the Township Attorney and the Mayor and Council. The Township is seeking proposals for attorneys/firms to provide services as Special Counsel to the Township. The quotation submitted should be in the form of an hourly rate for the calendar year 2025. The Township may appoint as many firms as is deemed necessary to meet the needs of the municipality.
