A. Provide examination services based on and in compliance with the National Association of Insurance Commissioner’s (NAIC) Market Regulation Handbook in effect at the time of the examination and MIA instructions. B. Under the direction of the MIA’s Market Conduct Examiner, prepare examination work papers and documents, including, but not limited to, queries, criticisms, and other documentation to provide evidence of actual work performed. Insurers may include entities to which an Insurer has delegated functions C. Prepare examination work papers and documents, including queries, criticisms, and other documentation, to provide evidence of actual work performed under the direction of the MIA’s Market Conduct Examiner. Insurers may include entities to which an Insurer has delegated functions. D. Research and conduct detailed analyses of insurer records, transactions, and practices related to the subject area of the examination. Subject areas of exams may include but are not limited to advertising and marketing materials, sales, underwriting, calculations of premium rates, health plan provider networks and directories, claims, underwriting, reinsurance and rating issues, form and content of notices, and entity-specific issues. E. Review the subject area of the exam for compliance with Maryland’s laws and regulations and federal laws, which Maryland has the authority to enforce. F. For other examination subject areas, work under the direction of the MIA’s Market Conduct Examiner to develop and execute a plan to review the practices and procedures, as written and in operation, of the Insurer or Producer for compliance with applicable law. G. Provide the MIA with weekly, detailed status updates in writing, unless otherwise authorized by State Contract Monitor, on a continuing basis, until the report (as described below) is completed to the satisfaction of the State Contract Monitor. H. Prepare a written report for each examination. The written report shall include a: 1) detailed discussion and findings of the examination conducted; 2) comprehensive written explanation and thorough documentation supporting any critical comments; and 3) summary of issues raised by the review and report, and any associated recommendations.
