Please note: This is a Sole Source Notification. To renew an existing agreement with LexisNexis for up to 6 months. The agreement covers a subscription service to the Lexis Prison Solution, which enables access to current state and federal case law, state statutes, and federal code, to support the individual legal research of approximately 8,000 incarcerated persons in facility libraries in Minnesota. The subscription allows users to conduct a legal search by official case citation, name, or subject matter to find related cases and principles of law, including using natural language search strategies. Additionally, this subscription offers the trademarked Shepard tool which places case law in historical and relevant context. The database allows users to access, download, and print materials. In addition to this, LexisNexis provides readily available technical and account support to facilitate the resolution of technical issues in cooperation with the staff of the facility, DOC, and MNIT. The service runs on the DOC’s secured IT network for incarcerated persons and cannot utilize on the State’s traditional IT network. Further, the database is tailored to meet the security requirements of the DOC to prevent unauthorized use and prevent an incarcerated person from accessing material outside the database. In addition, the content provided under the database has been reviewed to ensure that it covers all content required by Bounds v. Smith, 430 U.S. 813 (1977). At this time, the service provided by LexisNexis is the only service that has been approved as meeting both the DOC’s security and content standards. While the State recently posted a competitive solicitation to review and approve services provided by different vendors, the DOC must ensure continuity of services for incarcerated persons in the interim. For these reasons, the DOC has determined this to be a single source purchase.
