Specifications include, but are not limited to: A. In-person services are required. B. The third-party provider confirms that it is independent of association with private schools and/or any religious organization. All services must be secular, neutral and nonideological. C. The third-party provider confirms that their organization will comply with the Every Student Succeeds Act (ESSA) which requires that Title I services be provided by either an employee of a public agency Local Education Agency (LEA) or through a contract by the LEA with an individual association, agency or organization. These employees, individuals, associations, agencies or organizations must be independent of the private school and any religious organization in the provision of those services and such employment or contract must be under the control and supervision of the LEA. D. The third-party provider confirms that it will meet all applicable state, local, safety, and civil rights laws. E. The third-party provider confirms that it will ensure that all employees who will interact with eligible students have undergone background checks per A.R.S. § 15-106.
