Specifications include, but are not limited to: A. Provider’s Appellate Defense Services shall include, but will not be limited to the following activities in a case: 1. Entering an appearance with appellate court. 2. Consulting with clients, preferably in person, as soon as possible and maintaining contact throughout representation. 3. Ordering transcripts, requesting the official court record/pleadings in CARE, and requesting trial counsel’s files. 4. Reviewing the court record, pleadings, transcripts, and trial counsel’s file for appellate issues and supplementing the appellate record where needed. 5. Preparing a petition pursuant to URAP 55 and, if applicable, appellate briefs, motions, and petitions for Certiorari and subsequent briefing in the Supreme Court as required (if representing Appellant), or preparing a response brief, and responding to Certiorari pleadings as necessary (if representing Appellee) 6. Briefing all meritorious and relevant issues. 7. Briefing non-frivolous issues requested by the client. 8. Thoroughly researching the law specific to individual’s issues. 9. Working with an investigator to investigate facts and circumstances necessary to fully brief issues. 10. Using other defense resources as appropriate with approval from the Chief Appellate Officer. 11. Appearing for oral argument(s) in the case, and any other hearings directly relating to the assigned appeal. B. Provider will agree also to: 1. Make reasonable efforts to visit and communicate with clients, return telephone calls, respond to individual’s correspondence, keep the client updated on their appeal, and otherwise be accessible. Failure to maintain proper communications with client may result in the termination of the contract at the discretion of the Office or IADD. 2. Remain on the appeal through either the remittitur, or until termination of this Agreement by either party pursuant to this Agreement or for material breach. 3.
