Code Ann. §11-35-1570 with Vendor for the following supplies, services, information technology, or construction: The South Carolina Department of Health and Human Services (SCDHHS) is seeking to contract with Vendor to implement use of a secure Customer Relationship Management (CRM) tool and conduct applicant and provider outreach to obtain medical and other documentation needed for disability determinations. SCDHHS is responsible for determining Medicaid eligibility based on financial and non-financial criteria, including categorical criteria in compliance with certain federally established timelines. For applicants whose categorical eligibility is to be based on disability, a disability determination must be conducted based on rules set forth by the Social Security Administration. An applicant’s medical records supporting their attestation of disability are required as part of the process. The collection of these medical records from each applicant is time-consuming and often challenging, therefore creating a barrier to timely disability determinations. This in turn leads to delays in Medicaid determinations for these applicants. SCDHHS’s current contractor for conducting disability determinations has difficulties collecting required medical documentation to complete timely disability determinations. Failure to make timely Medicaid eligibility determinations delays applicants’ ability to access needed medical services potentially resulting in a threat to public health and the welfare of some of the most vulnerable citizens, as well as risking compliance with Centers for Medicare and Medicaid Services (CMS) timeliness standards as established by 42 CFR 435.912.The selected Vendor has a physical presence in Columbia, South Carolina, as well as both necessary technology assets with appropriate privacy/security controls and staffing expertise to provide these services. The Vendor has extensive experience working with State and Federal partners for Social Security Administration disability evaluations and determinations. This combination of factors will allow the Vendor to begin assisting with the backlog of work in an expedited manner to avoid delays in disability determinations risking health and welfare of applicants. A competitive procurement process at at this time under the current circumstances is not practical as it would significantly delay resolution and only compound the critical backlog situation. Until such time a competitive procurement is awarded and implemented, this emergency contract is critical in order for SCDHHS to provide the ability of applicants to access needed medical services and comply with CMS timeliness standards.
